About modification of some regulatory legal acts of the National Bank of Ukraine

According to article 7 of the Law of Ukraine "About the National Bank of Ukraine", for the purpose of ensuring money recovery from accounts of payers of taxes/subjects of managing by bodies of the State Tax Service according to requirements of the Tax code of Ukraine the Board of the National Bank of Ukraine DECIDES:

1. Approve Changes to the Instruction about clearing settlements in Ukraine in the national currency approved by the resolution of Board of the National Bank of Ukraine of 21.01.2004 No. 22, of Ukraine registered in the Ministry of Justice 29.03.2004 for No. 377/8976 (with changes) which are applied.

2. Approve Changes to the Instruction about interbank money transfer in Ukraine in the national currency approved by the resolution of Board of the National Bank of Ukraine of 16.08.2006 No. 320, of Ukraine registered in the Ministry of Justice 06.09.2006 for No. 1035/12909 (with changes) which are applied.

3. To department of information technologies (Bilash O. O.) to make corresponding changes to the software of electronic payment system of the National Bank of Ukraine.

4. To chiefs Operational and territorial administrations of the National Bank of Ukraine, to banks of Ukraine to make corresponding changes to the software of systems of automation of bank concerning processing of collection orders (orders).

5. To general department of information technologies and payment systems (Sinyavskaya N. B.) after state registration in the Ministry of Justice of Ukraine to bring contents of this resolution to permission Operational, territorial administrations of the National Bank of Ukraine and banks of Ukraine for use in work.

6. The resolution becomes effective in 30 days after official publication.

Changes to the Instruction about clearing settlements in Ukraine in national currency

1. In Chapter 1:

1.1. To add Item 1.1 after words of "The economic code of Ukraine" with words of "The tax code of Ukraine".

1.2. In Item 1.3 of the word "which perform forced write-off of funds from accounts of these participants" to exclude.

1.3. To add Item 1.4 after the paragraph of the eighteenth with the new paragraph of such content:

"the collection order (order) - the settlement document which contains the requirement of the claimant (body of the State Tax Service) to the bank servicing the payer to make transfer of certain amount of funds from the account of the payer into the account of the receiver without approval of the payer".

With respect thereto the nineteenth - the fifty fourth to consider paragraphs respectively paragraphs the twentieth - the fifty fifth.

1.4. In Item 1.7 of the word and figure of "payment requests of claimants in case of forced write-off of means according to Chapter 5 of this Instruction" shall be replaced with words also in figures of "settlement documents of claimants according to Chapters 5 and 12 of this Instruction".

2. In Chapter 2:
