ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

About modification and amendments in the orders of the Government of the Republic of Kazakhstan of January 31, 2001 No. 168 "About approval of some instructions" and of December 10, 2002 No. 1300 "About Regulations of the Government of the Republic of Kazakhstan"

The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of January 31, 2001 No. 168 "About approval of some instructions":

in the Instruction on clerical work in Prime minister's department of the Republic of Kazakhstan approved by the specified resolution:

in all text of the word "sector of office correspondence", "the sector of office correspondence", "the sector of office correspondence", "the sector of office correspondence" to replace respectively with the words "sector of clerical work and archive", "sectors of clerical work and archive", "the sector of clerical work and archive", "the sector of clerical work and archive";

"3. This Instruction determines rules of preparation, registration, passing of documents of unclassified nature and having mark "For office use".

3) of item 4 to state the subitem in the following edition:

"3) maintaining confidential clerical work and confidential correspondence with use of the encoded document connection which is established by separate special instructions.";

"8. The incoming correspondence arriving in Office on paper is accepted by the sector of clerical work and archive of Inspection department and documentary providing (further - the sector of clerical work and archive) under list with indication of date, time, surname and initials of person who received documents, and electronic documents certified by the digital signature - after holding procedure of verification of the digital signature with use of means of cryptographic information security (further - the EDS) person which signed the electronic document and person who certified necessary details of the document.

The electronic documents certified by the EDS shall be transmitted through the Single transport circle of state bodies of the Republic of Kazakhstan (further - ETC) and the server of the Center of interdepartmental document flow of the Single system of electronic document management of state bodies (further - TsMD ESEDO).

In case of acceptance of correspondence in format of electronic documents all further procedures with these documents are made according to the Instruction of the user of the Single system of electronic document management (further - ESEDO).

Notes and letters of foreign embassies are accepted only through the Ministry of Foreign Affairs of the Republic of Kazakhstan.";

"12. The first copies of documents which shall be drawn up on the form of the established sample, signed by the first head (in its absence - person fulfilling its duties, in the presence of the order, the responsible secretary on the questions carried to its competence, the official of the ministry or agency, certain President of the Republic of Kazakhstan and performing powers of the responsible secretary) or created with use of the template of the electronic document corresponding to it with the filled details (the electronic documents certified by the EDS, having confirmation about determination in accordance with the established procedure of positive result of verification of the EDS) are subject to acceptance in Office. To letters of the state bodies responsible for execution of orders of the Management of the Government, copies of letters of the state bodies collaborators are without fail put. On the document shall be put down: date, reference number, short heading of the document, in case of reply to the request or the report (information) on execution of orders - the reference to registration number of Office. At the same time the Office accepts only those documents which date matches with date of their delivery in Office (except correspondence from another town which arrived by mail). The surname, initials, phone number of the contractor, and also number of copies of the document are without fail put down in the bottom right corner after the signature or on the back of the first document sheet (for example: Asanov S.A., ph. 742469). Appendices to the document shall be initialed by the person which signed or preparing the document.

Correspondence of state bodies (including the electronic documents certified by the EDS) addressed to management of the Government and the Head of Office shall be drawn up on the stamp form in state language (the option in Russian is in case of need put).

In case of acceptance of the electronic documents certified by the EDS, number of copies is not considered.

The electronic documents certified by the EDS, arriving in Office in time off are stored in the ESEDO corresponding folder before registration or refusal in acceptance by the employee of the sector of clerical work and archive";

state Items 13-1 and 13-2 in the following edition:

"13-1. All correspondence (documents) arriving in Office is accepted from 9:00 to

15:30 hours are also registered the sector of clerical work and archive which fills on each arrived document registration and control card for registration entering (outgoing, internal) of documents (appendix 1 to this Instruction).

13-2. The manager of the sector of clerical work and archive does previously marking of the arrived documents and other office correspondence, distributes on competence. Distribution of the arrived documents and other office correspondence to the Management of the Government, Office is performed depending on nature, importance and urgency of the questions posed.

After preliminary consideration the arrived documents and other office correspondence are registered in accordance with the established procedure. The documents specified in appendix 3 to this Instruction are not subject to registration.";
