About approval of Safety rules in case of operation of channels, pipelines, other hydraulic engineering constructions for water management systems

According to article 28 of the Law of Ukraine "About labor protection", the subitem 41 of item 4 of the Regulations on the Ministry of emergency situations of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 402, I ORDER:

1. Approve Safety rules in case of operation of channels, pipelines of other hydraulic engineering constructions for water management systems which are applied.

2. To public service of mountain supervision and industrial safety of Ukraine (Hokhotva O. I.):

2.1. In accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

2.2. In accordance with the established procedure to introduce the order in State the register of regulatory legal acts concerning labor protection.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the Chairman of Public service of mountain supervision and industrial safety of Ukraine Hokhotva O. I.

Safety rules in case of operation of channels, pipelines, other hydraulic engineering constructions for water management systems

I. General provisions

1.1. Requirements of these rules extend to all companies, organizations, the organizations irrespective of subordination and patterns of ownership (further - the companies), and also to physical persons - entrepreneurs who perform operation of water management systems.

1.2. These rules establish organizational and technical requirements concerning providing safe working conditions during operation of water management systems which include meliorative systems with channels, water waste, water throughput and other constructions, pipelines with the water adjusting equipment, collector and drainage system with constructions on it, coast protection, and also protective constructions.

1.3. Terms which are used in these rules have such values:

water economy - industry which task is the requirements satisfaction of the population and industries of economy in water resources, preserving, protection and reconstruction of water fund, protection of the territories against harmful effect of waters or liquidation of its effects;

the hydraulic engineering construction - the engineering construction intended for management of the water mode, use of water resources or for prevention of harmful effect of waters;

operation of water management system, construction, - use of water management system, construction according to functional purpose and carrying out necessary measures (maintenance, inspection, carrying out repair work), concerning preserving condition of structural elements in case of which they are capable to perform the set functions with parameters which are determined by requirements of technical documentation.

1.4. General requirements

1.4.1. In each company instructions for labor protection according to requirements of the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of January 29, 1998 No. 9, registered in the Ministry of Justice of Ukraine on April 07, 1998 for No. 226/2666 are developed (NPAOP 0.00-4.15-98).

1.4.2. Training and examination concerning labor protection of employees of the companies are carried out according to requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 231/10511 (NPAOP 0.00-4.12-05), concerning fire safety - according to requirements of the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash against September 29, 2003 No. 368 "About approval of the List of positions, in case of appointment to which faces shall undergo training and examination concerning fire safety, and procedure for their organization and Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine", registered in the Ministry of Justice of Ukraine on December 11, 2003 for No. 1147/8468 (NAPB B.02.005-03).

1.4.3. Preliminary (during employment) and periodic (during labor activity) medical examinations of workers are performed at the scheduled time according to requirements of the Procedure for the performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

1.4.4. Persons, are younger than 18 years, are not allowed to work on the positions specified in the List of hard work and works with harmful and dangerous conditions works on which application of work of minors, No. approved by the order of the Ministry of Health of Ukraine of March 31, 1994 46, registered in the Ministry of Justice of Ukraine on July 28, 1994 for No. 176/385 is forbidden.

1.4.5. During execution of works with use of work of minors it is necessary to fulfill Limit requirements of rates of raising and movement of the heavy things by minors approved by the order of the Ministry of Health of Ukraine of March 22, 1996 No. 59, registered in the Ministry of Justice of Ukraine on April 16, 1996 for No. 183/1208.

1.4.6. Women are not allowed to the works determined by the List of hard work and works with harmful and dangerous working conditions on which application of work of women, by the approved order of the Ministry of Health of Ukraine of December 29, 1993 is forbidden to No. 256, registered in the Ministry of Justice of Ukraine on March 30, 1994 for No. 51/260.

1.4.7. Women are not allowed to works which nature is connected with raising and cargo transfer in case of alternation with other work to 2 times an hour which mass exceeds 10 kg, and is permanent during working shift - 7 kg according to Limit rates of raising and movement of heavy things by the women approved by the order of the Ministry of Health of Ukraine of December 10, 1993 No. 241, registered in the Ministry of Justice of Ukraine on December 22, 1993 for No. 194.

1.4.8. Workers who carry out repair construction works on hydraulic engineering and protective constructions shall be provided with sanitarnobytovy rooms (wardrobe, rooms for drying of clothes and footwear, shower, rooms for meal, rest and heating, rooms of hygiene of women and toilets) according to requirements of DBN B.2.2-28-2010 "Houses and constructions. Houses of administrative and household purpose".

1.4.9. All workers performing works on operation of water management systems are provided with free of charge special clothes, special footwear and other individual protection equipment, according to requirements of the Regulations on procedure for the providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of March 24, 2008 No. 53, registered in the Ministry of Justice of Ukraine on May 21, 2008 for No. 446/15137 (NPAOP 0.00-4.01-08), and according to Regulations of free issue of special clothes, special footwear and other individual protection equipment, the workers of water economy approved by the order of the State committee of Ukraine on industrial safety to labor protection and mountain supervision of October 12, 2009 No. 169, registered in the Ministry of Justice of Ukraine on November 03, 2009 for No. 1017/17033 (далееНПАОП 0.00-3.08-09).

Workers of general professions which work at servicing of water management systems are provided with free of charge special clothes, special footwear and other individual protection equipment, according to Regulations of free issue of special clothes, special footwear and other individual protection equipment to the workers of general professions of different industries approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of April 16, 2009 No. 62, registered in the Ministry of Justice of Ukraine on May 12, 2009 for No. 424/16440 (NPAOP 0.00-3.07-09).

1.4.10. On the site of repair construction works all workers shall be provided with drinking water which quality shall meet health requirements according to ГСанПиН 2.2.4.171-10 "Hygienic requirements to the drinking water intended for the use by the person".

Items of spill of the conditioned imported drinking water it is necessary to have at the distance which is not exceeding 75 m from workplaces at least than 50 m from places of pollution (dustbins, bathrooms, highways with heavy traffic of transport, car park and so forth).

1.4.11. Heads of the companies shall provide the timely notification of all the divisions and subcontract organizations working at under control objects about sharp changes of weather (storm, gale-force wind, thunder-storm, snowfall and so forth) for removal of workers and the equipment from dangerous sites of work.

1.4.12. Conducting investigation and accounting of accidents, occupational diseases and accidents which happened at the company are performed according to the Procedure for conducting investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232.

1.4.13. During execution of works which are not specific to water economy it is necessary to be guided by the corresponding existing regulatory legal acts on labor protection.

ІІ. Safety requirements in case of performance of works on repair of hydraulic engineering constructions

2.1. General requirements

2.1.1. Accomplishment of repair work during operation of objects on water management systems needs to be performed according to the approved head of project organization of performance of works (далееПВР) according to requirements of DBN A.3.2-2-2009 "Occupational safety standards system. Labor protection and industrial safety in construction. Basic provisions" (further - DBN A.3.2-2-2009).

2.1.2. Accomplishment of installation and construction works without TAC according to Item 4.2 of Chapter 4 of DBN A.3.2-2-2009 is forbidden.

2.1.3. Such dangerous and harmful factors can influence workers who perform operation of water management systems:

physical: machines and mechanisms which move; mobile parts of production equipment; laser radiation; the increased or reduced humidity of air; the increased or reduced air temperature of the working area, the equipment, pipelines; infrasound and ultrasound; the increased noise level, vibrations, infrasonic fluctuations, ultrasound, the increased vibration level on workplaces; the increased or reduced speed of movement of air; the increased value of tension in electric circle which short circuit can take place through body of the person; the increased intensity electric or magnetic water; absence or insufficiency of natural light; insufficient illumination of the working area;

psychophysiological: physical overworks (static and dynamic); psychological overloads (emotional overloads).

2.1.4. Based on the List of works with the increased danger, the State committee of Ukraine on supervision of labor protection approved by the order of January 26, 2005 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 232/10512, and the approximate list of work types on which implementation it is necessary to issue the work permit given in appendix K to DBN A.3.2-2-2009, taking into account local conditions and specifics of operation of water management systems the employer develops No. and approves the list of works on which accomplishment it is necessary to issue the work permit.

The work permit on performance of works of the increased danger is issued prior to works where is or there can be production danger, to the executive in charge of works.

The work permit is issued for the term necessary for accomplishment of the set amount of works, but it is no more than 15 calendar days since the beginning of work. In case of change of conditions of implementation of works the work permit is cancelled and it is allowed to resume works only after issue of the new work permit.

The official who issued the work permit on performance of works shall exercise control over the implementation by workers of measures for work safety.
