The government of the Republic of Tajikistan and the Government of the Republic of Belarus which are referred to as further with the Parties, aiming at all-round development of cooperation between the Parties in the field of temporary employment of citizens of the states of the Parties in the territories of both states, agreed as follows:
Action of this agreement extends to the citizens of the Republic of Tajikistan who are temporarily finding a job in the territory of the Republic of Belarus and the citizens of the Republic of Belarus who are temporarily finding a job in the territory of the Republic of Tajikistan and also members of their families.
This agreement is not applied to persons which do not have the status of the migrant worker according to the national legal system of the Party of employment.
For the purposes of this agreement stated below terms mean the following:
the worker - the migrant - person who is the citizen of the state of one Party who legally is and engaged in temporary labor activity in the territory of the state of other Party in which he constantly does not live;
family members - persons who are those according to the national legal system of the Party of employment;
The party of employment - the state of one of the Parties in which the migrant worker performs temporary labor activity;
the employer - the legal entity irrespective of pattern of ownership or organizationally - legal form and organization, and also physical person which according to the national legal system of the Party of employment employ the migrant worker according to the employment contract;
