About modification of the Land code No. 828-XII of December 25, 1991

The Parliament adopts this organic law.

Art. I. - In the Land code No. 828-XII of December 25, 1991 (repeated publication: The official monitor of the Republic of Moldova, 2001, No. 107, of the Art. 817), with subsequent changes to make the following changes:

1. State Article 36 in the following edition:

"Article 36. Earth of agricultural purpose

The earth of agricultural purpose, irrespective of pattern of ownership, are used for implementation of activities for the purpose of receipt of agricultural products and placement of objects of agricultural infrastructure.

Belong to the category of lands of agricultural purpose:

a) farmlands (arable, including greenhouses, sunbeds and nurseries, laylands, gardens, vineyards, nut plantings, mulberry plantations, fruit bushes, meadows, pastures, kitchen gardens, gardening sites and another similar it, having vegetation);

b) the lands occupied with the warehouses, refrigerators intended for storage of agricultural products, currents, repair shops, constructions for storage of agricultural mechanisms (aggregates), livestock farms, including fishery objects and also forest belts, anti-erosive lakes, roads of agricultural purpose, drying and irrigational constructions if they were not referred to other category of appointment.".

2. State Article 73 in the following edition:

"Article 73. Change of procedure for use of farmlands

Change of procedure for use of the farmlands specified in Item and) Article parts two 36, is performed by their owner or the owner with the consent of the owner.

In 30-day time after change of procedure for use of the farmlands specified in Item a) Article parts two 36, the owner of land shall inform in writing on it bodies of local public authority of the first level.
