Section I. Lease. General provisions about lease

Article 1. Lease

Lease represents the urgent paid ownership based on the agreement and use of the earth, other natural resources, the companies and other property complexes, and also other property necessary for the lessee for independent implementation of economic or other activity.

Article 2. Legislation on lease

The relations on lease in the Turkmen SSR are governed by Bases of the legislation of USSR and federal republics about lease, this Law and legal acts of USSR and the Turkmen SSR published according to them, and in the cases provided by these legal acts - also resolutions of Council of Ministers of the USSR and Council of Ministers of the Turkmen SSR.

Article 3. Sphere and object of lease

Lease is allowed in all industries of the national economy and can be applied to property of all forms and types of property.

Can be leased:

a) lands and other natural resources;

b) companies, organizations, associations, their separate divisions, productions, workshops, other divisions of the companies, organizations, associations as single property complexes of business assets and other values;

c) certain buildings, constructions, equipment, vehicles, stock, tool and other material values.

The legislation of USSR and the Turkmen SSR establishes types (groups) of the companies, organizations and property types which delivery in lease is not allowed.
