About determination of the list of exceptional cases when separate cars, locomotives, other elements of railway vehicles can be excluded from the train for carrying out customs control

According to part three of Article 220 of the Customs code of Ukraine and the subitem 64 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 08, 2011 No. 446, I ORDER:

1. Determine that separate cars, locomotives and other elements of railway vehicles upon the demand of customs authority can be excluded from the train for implementation of customs control if carrying out such control in the train is impossible, in such exceptional cases:

1.1. Not giving to customs authority of the documents necessary for implementation of customs control, or representation as the bases for movement of the goods of the documents counterfeited or received in the illegal way or such which contain inveracious data.

1.2. Damages or losses of the seals, seals or other means of identification specified in carriage and accompanying documents.

1.3. Identifications of the goods hidden from customs control, in particular with use of specially made storages (hiding places) and other means or methods which trouble identification of such goods, or by representation to one goods of type of others.

1.4. Revenues to the border transfer station of goods which are subject to the state sanitary and epidemiologic, veterinary sanitary, phytosanitary, environmental and radiological control, before receipt of results of such types of control or if the weight of evidence suggests that the goods which move through customs border of Ukraine including en route, can be subject to such types of control, in particular upon the demand of relevant organs of the government.

1.5. Checks of compliance of information on goods declared in carriage and accompanying documents, to actual data if such check requires carrying out transactions on unloading, overload, repacking and so forth.
