Section I. General provisions

Article 1. Concept about subsoil

Subsoil the part of crust located below soil layer and bottom of reservoirs available to geological studying and development is recognized.

Resources of subsoil - irreplaceable national wealth. Rational use and protection of subsoil for the benefit of these and future generations - priority of the state and society.

Article 2. Legislation of Turkmenistan on subsoil

The legislation of Turkmenistan on subsoil is based on the Constitution of Turkmenistan and consists of this Law and other legal acts of Turkmenistan adopted according to it.

Regional authorities and managements issue acts on regulation of the relations of subsurface use within the powers determined by this Law.

The relations connected with use and protection of lands, waters, plant and animal life, atmospheric air, arising when using natural resources are regulated by the relevant legislation of Turkmenistan.

Article 3. Property on subsoil

Subsoil and their resources are exclusive property of the state which delegates to regional authorities and managements of the right on single questions of regulation of the relations of subsurface use. The purchase and sale of subsoil is not allowed.
