The agreement on the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States

The governments of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties

in view of need of increase in efficiency of joint fight against crime, terrorism, other challenges and threats in the territories of the State Parties of the Commonwealth of Independent States,

realizing that creation of the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States is equitable to interests of safety of the people of their states,

proceeding from the purposes and tasks of the Commonwealth of Independent States,

agreed as follows:

Article 1

The parties create the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States in accordance with the terms, stated in the Technical requirements approved according to Article 2 of this agreement.

Article 2

The parties claim:

Technical requirements (are attached) to the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States;

The specification on the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States (is attached);

The single list of accounting data (is attached).

Article 3

The parties create within the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States, the bank of accounting data founded on the distributed structure of data from national databases (without mutual integration of national information systems).

Article 4

Customer of works is the Federal Migration Service (FMS of Russia) which will organize tendering process (tenders, auctions) on creation of the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the CIS with attraction as members of the tender commission and experts of agents of the parties.

Article 5

The parties in three-months time from signature date of this agreement inform depositary on the authorized bodies, actionees of this agreement.

Article 6

The procedure for replenishment, use of resources of the Single system of accounting of citizens of the third states and stateless persons driving in the territory of gosudarstvuchastnik of the Commonwealth of Independent States, the rule of the address with information, and also procedure for financing of joint operations will be determined by development, creation and development of the specified system by separate documents.

Article 7

This agreement is temporarily applied from signature date and becomes effective after 30 days from the date of receipt by depositary of the third notification on accomplishment by the Parties of the interstate procedures necessary for its entry into force which signed it.

For the Parties which performed interstate procedures later this agreement becomes effective after 30 days from the date of receipt by depositary of the relevant documents.

Article 8

By mutual consent of the Parties changes and additions which are drawn up by the relevant protocol can be made to this agreement.

Article 9

The matters of argument between the Parties arising in case of application and interpretation of this agreement are solved by consultations and negotiations of concerned parties.

In case of impossibility to settle matters of argument by consultations and negotiations of the Party on consent appeal to Economic Court of the Commonwealth of Independent States.

Article 10

This agreement after its entry into force is open for accession of other State Parties of the Commonwealth of Independent States dividing its provisions and ready to assume liabilities following from this agreement. For the joining state this agreement becomes effective after 30 days from the date of receipt by depositary of the document on accession.

Article 11

This agreement is signed sine die. Each of the Parties can leave this agreement, having sent the written notice of the intention to depositary not later than 6 months before date of exit and having settled the financial and other liabilities which arose during action of this agreement.

It is made in the city of St. Petersburg on October 18, 2011 in one authentic copy in Russian. The authentic copy is stored in Executive committee of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.

2. APPOINTMENT, PURPOSES AND MAIN OBJECTIVES OF ESU OF THE CIS

This document contains technical requirements to development of the Single system of accounting of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth of Independent States, and also technical and economic and financial and economic reasons for its creation (appendices 1 and 2) and the possibility of creation and operation on the ESU resources of the CIS considers:

systems of exchange of information about illegal migration between competent authorities of state members of the Collective Security Treaty Organization (CSTO);

Interstate databank about migrant workers of state members of Eurasian economic community (MBDTM of EurAsEC).

The document determines appointment and scope, the technical and special requirements imposed to ESU of the CIS, necessary stages of development, procedure for its control and acceptance.

2.1. Appointment

ESU of the CIS shall provide collection, storage, data processing, the citizens of the third states and persons without citizenship driving in the territory of the State Parties of the CIS, access for the interested users to the distributed information resources, and also provision by it of data (data) on GTG and LBG, opportunities of search and analytical requests, any analytical and standard statistic reports on the basis of use of modern information and telecommunication technologies belonging to movements.

2.2. Purposes of creation of ESU of the CIS

The purposes of creation of ESU of the CIS are:

improvement of quality of interstate information exchange for the benefit of preparation and acceptance of organizational management decisions in the field of control of movements of GTG and LBG on the territories of the State Parties of the CIS which signed the Agreement on the Single system of accounting of citizens of the third states and stateless persons, driving in the territory of the State Parties of the Commonwealth of Independent States;

implementation, on the basis of the single list of accounting data, the automated collection, processing, accumulating, storage, transfer and use of information allowing to keep timely account of citizens of the third states and stateless persons crossing frontiers of the State Parties of the CIS.

2.3. Characteristic of object of automation

Object of automation are joint activities of the interested public authorities of the State Parties of the Commonwealth of Independent States which are agreement parties about the Single system of accounting of citizens of the third states and stateless persons driving in the territory of gosudarstvuchastnik of the Commonwealth of Independent States, their structural divisions on accounting, control of entrance and departure, observance of regulations of stay of citizens of the third states and stateless persons driving in the territory of the State Parties of the Commonwealth for the purpose of assistance to safety of the State Parties of the Commonwealth, to increase in efficiency of joint fight against terrorism, transnational crime, illegal migration and other challenges and safety hazards in the territories of the State Parties of the Commonwealth.

The main interested bodies in the created system are bodies:

border control;

internal affairs, immigration and passport and visa control;

customs and transport control;

other competent authorities.

3. REQUIREMENTS TO ESU OF THE CIS IN GENERAL

3.1. General requirements

3.1.1. Designing and realization of ESU of the CIS shall be carried out taking into account the following requirements to the automated system:

scalability - capability to increase in functionality of system by building-up of number of the function blocks which are carrying out the same tasks;

openness - use of the unified decisions providing simplicity of building-up of the ESU resources of the CIS and opportunities of interaction;

self-sufficiency - realization of functional completeness and independence of development of the ESU components of the CIS;

reliability - capability with guarantee to perform the functions in the set service conditions;

adaptivity - capability to perform the functions under the changing service conditions;

unification - use of prototype project solutions, possibility of use of decisions in any regional division of NGO;

profitability - ensuring necessary functionality in case of the set restrictions for the cost of creation, operation and maintenance;

safety - capability to resist to attempts of unauthorized access, protection against loss of data as a result of failures, accidents, disasters.

3.1.2. As basic architecture of ESU of the CIS creation of components according to the scheme shall be used:

The DPC of ESU of the CIS providing single administration, classification system, codings and normative reference information. The location of DPC is determined by the Customer;

the national nodes representing the application servers certifying the center of the digital signature and database about entry departure of citizens of the third states and stateless persons, migrant workers into the State Party of ESU of the CIS and other data according to the Single list of accounting data. The location of node determines the State Party of the Agreement;

secure channels of communication between DPC and national nodes of gosudarstvuchastnik of ESU of the CIS;

information locks of data exchange and routing between DPC and national nodes of the State Parties of ESU of the CIS.

3.1.3. During creation of ESU of the CIS integration and interaction of components of system (subsystems and components) shall be provided.

3.1.4. During creation of ESU of the CIS the possibility of extension of the Single list of accounting data, and also abilities to integrate and interactions with other information systems shall be provided.

3.1.5. Sets of the software shall function within specially allocated technical means with single system of management of information processes.

3.1.6. Sets of automated workplace shall be under construction proceeding from the principle of creation of the unified approach.

3.1.7. ESU of the CIS is under construction on the basis of the existing and newly created national information systems of the State Parties of the CIS.

3.1.8. ESU of the CIS and its components - national information and accounting systems - are developed or improved on the basis of application of prototype project and technical solutions taking into account opportunities of use of the existing information, program and technical, telecommunication and personnel resources, and also modern achievements in the field of informatization and automation of processes of data exchange.

3.1.9. In case of development of standard projects of software and hardware complexes of the automated systems of check points through frontier the possibility of receipt of information on person by means of machine-readable identity documents can be one of criteria.

3.1.10. Subscriber posts and Items can be the main sources or correspondents of accounting data in the State Parties of the CIS:

bodies of border control (passport and visa supplied, the information on crossing of frontiers);

bodies of customs and transport control (data on entrance and departure, routes);

law-enforcement bodies, migratory/immigration and passport and visa control (data on the issued (prolonged) visas, invitations, and also on change of regulations of stay in the territories and about committed violations of the migratory legislation);

security service and foreign affairs (data on the issued (prolonged) visas and invitations);

other competent authorities.

3.2. Requirements to structure of ESU of the CIS

3.2.1. The generalized architecture of ESU of the CIS shall include the components provided in the drawing (fig. 1).

3.2.2. Shall be part of complex of technological subsystems of ESU of the CIS:

subsystem of collection and data processing;

subsystem of the guaranteed delivery of data;

data exchange subsystem;

data storage subsystem;

subsystem of backup and recovery of data;

subsystem of maintaining normative and help informatsii1;

subsystem information and analytical and execution of search and analytical requests;

subsystem of maintaining the Single catalog of users of ESU of the CIS;

subsystem of administration of users and audit of actions of users of ESU of the CIS;

subsystem of support of the EDS;

subsystem of internal e-mail of ESU of the CIS;

subsystem of monitoring of condition and management of ESU of the CIS;

subsystem of information security;

subsystem of field service of requests of users of TsBD;

subsystem of life support of ESU of the CIS.

3.2.3. The hardware and software system of ESU of the CIS shall include:

server hardware;

telecommunication equipment (equipment of data transmission network);

data storage equipment;

equipment of backup and recovery of data;

equipment of certification center;

information security equipment;

sets of the structured cable systems on objects of ESU of the CIS;

sets of the automated workplaces of users and the operating personnel on objects of ESU of the CIS.

3.2.4. At stage of technical designing refining of structure of subsystems, redistribution of functions of subsystems both within one subsystem, and between different subsystems is allowed.

3.3. Requirements to functioning

ESU of the CIS shall provide functioning in the following modes:

the normal mode - the mode of functioning of all subsystems of ESU of the CIS;

the autonomous mode - the mode which is characterized by violation of information or telecommunication exchange. In this case autonomous functioning shall be provided;

the service mode - the mode to which separate components and subsystems for carrying out their maintenance, reconfiguration and upgrade are transferred. The service mode shall provide realization of the most critical functions necessary for maintenance of functioning of the main services and operating modes of ESU of the CIS.

3.4. Requirements to reliability

3.4.1. Decisions on creation of ESU of the CIS, the choice of hardware-software components shall consider the following list of possible refusals:

failure of life support system;

failure of elements of network infrastructure of LVS/SPD;

failure fully or partially single server;

failure fully or partially disk array;

failure of consoles of management and other controls;

failure of the equipment of backup and/or archiving;

violations in work of software;

failure of active or passive components of network of data storage;

violation (failure) of logical integrity of information which is stored in system.

3.4.2. Technical supply of reliability of functioning of subsystems of ESU of the CIS is implemented at stage of technical designing and shall provide:

preserving functionality during all useful life of ESU of the CIS;

reservation of crucial components and data ESU of the CIS for achievement of necessary level of reliability of system;

use of technical means with excessive components and possibility of their hot replacement;

reservation of computing capacity, network and other equipment;

resistance to any refusal of its technical elements (replaceable blocks and modules);

configuring of the used means and application of the specialized software providing fault tolerance;

safety of information in case of shutdown of power supply, including in case of sudden shutdown;

the software for diagnosing of failures and equipment failures and conducting testing of devices before work, backup of data ESU of the CIS.

3.4.3. The structure and topology of server components the PACK ICE ESA SNG shall be determined by the principle of lack of single point of refusal by provision of information services to users of ESU of the CIS.

3.5. Requirements to qualification of users and personnel of ESU of the CIS, and also to the mode of their work

3.5.1. Qualification of users of ESU of the CIS shall conform to the current requirements to the level of knowledge of subject domain and include necessary skills of work with the personal computer.

3.5.2. System technical solutions about creation of ESU of the CIS shall be chosen taking into account training of the operating personnel on category not below category "engineer".

3.5.3. By the contractor the program for training of the operating personnel in volume of the specification approved by the Agreement shall be developed and approved with the Customer. The contractor provides training of personnel of the Customer according to the approved training program to stage of input of ESU of the CIS in operation.

3.5.4. The training program shall include training of personnel in the following qualification directions:

user training to application of SPO of ESU of the CIS and applied informatsionnoanalitichesky subsystem to destination;

training of specialists on setup and administration of applied subsystem;

training of specialists on servicing of the computer and telecommunication facilities used in ESU of the CIS;

training of specialists on administration of subsystems of ESU of the CIS.

3.6. Requirements to safety of work of the operating personnel

3.6.1. The equipment used in ESU of the CIS shall ensure safety of its functioning and use by the operating personnel on condition of observance of service regulations of this equipment.

3.6.2. The design PAK ESA SNG shall provide accomplishment of modern requirements to protection of the operating personnel against defeat electric tokom2. Connection of power supply to the equipment of ESU of the CIS shall be carried out according to requirements industrial pravil3.

3.6.3. The personnel having sufficient theoretical and practical preparation shall be allowed to operation of the equipment of ESU of the CIS. Operational documentation shall contain instructions for safety in case of operation and maintenance.

3.6.4. Placement of the equipment on workplaces shall provide its safe servicing and operation.

3.7. Requirements to ergonomics and industrial art

3.7.1. Design and design decisions shall conform to modern requirements to ergonomics and technical estetike4.

3.7.2. Ergonomic decisions shall provide convenience of operation and servicing of software and hardware of ESU of the CIS.

3.7.3. The automated workplaces for employees shall meet modern sanitary standards and pravilam5.

3.7.4. Climatic conditions of operation shall conform to requirements to the environment parameters recommended by producers of the equipment.

3.8. Requirements to operation

3.8.1. The main subsystems of ESU of the CIS shall be under construction taking into account ensuring simplicity and the maximum automation of maintenance. All decisions used in ESU of the CIS shall be based on the approved technologies for which preparation of its service personnel can be organized.

3.8.2. The equipment shall be chosen taking into account continued (round-the-clock) operation of its main components.
