Article 1

Article 20 of the Federal Law of December 10, 1995 No. 196-FZ "About traffic safety" (The Russian Federation Code, 1995, No. 50, Art. 4873; 2002, No. 18, Art. 1721; 2009, No. 48, Art. 5717; No. 25, the Art. 3268) to add 2012, with item 4 of the following content:

"4. The legal entities and individual entrepreneurs transporting road transport and urban land electric transportation shall:

provide availability in the organization of the official responsible for safety of traffic and undergone in accordance with the established procedure certification on the right to hold the corresponding position;

provide compliance of workers to the professional and qualification requirements imposed when implementing transportations and established by the federal executive body performing functions on development of state policy and normative legal regulation in the field of transport if other is not established by the Federal Law;

provide availability of the rooms and the equipment allowing to perform the parking, maintenance and repair of vehicles, or the conclusion of contracts with the specialized organizations about the parking, maintenance and repair of vehicles; organize and perform pretrip and posttrip medical examinations of drivers, pretrip control of technical condition of vehicles.

The list of actions for training of workers for safe work and vehicles to safe operation, frequency of conducting the corresponding checks are determined by the federal executive body performing functions on development of state policy and normative legal regulation in the field of transport.".

Article 2

Bring in the Code of inland water transport of the Russian Federation (The Russian Federation Code, 2001, No. 11, Art. 1001; 2003, No. 14, Art. 1256; No. 27, Art. 2700; 2004, No. 27, Art. 2711; 2006, No. 50, Art. 5279; No. 52, Art. 5498; 2007, No. 27, Art. 3213; No. 46, Art. 5554, 5557; No. 50, Art. 6246; 2008, No. 29, Art. 3418; No. 30, Art. 3616; 2009, No. 1, Art. 30; No. 18, Art. 2141; No. 29, Art. 3625; No. 52, Art. 6450; 2011, No. 15, Art. 2020; No. 27, Art. 3880; No. 29, Art. 4294; No. 30, Art. 4577, 4590, 4591, 4594, 4596; No. 45, Art. 6333, 6335; 2012, No. 18, Art. 2128; No. 25, Art. 3268; No. 26, Art. 3446) following changes:

Article 3 to add 1) with paragraphs of the following content:

"administration of the pool of inland waterways - the organization created in the form of state budgetary institution and performing in the pool of inland waterways content of inland waterways and the navigable hydraulic engineering constructions located on them, the state port control and other functions determined according to this Code;

the pool of inland waterways - the part of inland waterways isolated and having general navigable waters, climatic, navigation and hydrographic conditions of ensuring navigation of vessels and hydroweather conditions.";

2) in Article 4:

a) state Item 1 in the following edition:

"1. State regulation in the field of inland water transport is performed by the federal executive body performing functions on development of state policy and normative legal regulation in the field of transport (further - federal executive body in the field of transport), is direct or through the state organizations which are under its authority, and also other federal executive bodies within the powers conferred to them.";

b) declare Item 3 invalid;

3) in Article 4.1:

a) add Item 1 with words ", except for checks of the courts and other floating objects performed according to Article 38.1 of this Code";

b) add Item 2 with words ", Article 38.1 of this Code";

c) to declare the subitem 3 of item 4 invalid;

d) add with Item 7.1 of the following content:

"7.1. The officials of state supervision body who are the state transport inspectors have the right:

To request 1) from public authorities, local government bodies, legal entities, physical persons, including individual entrepreneurs and to receive from them based on motivated requests in writing information and documents necessary during conducting check;

2) freely upon presentation of the official ID and the copy of the order (order) of the head (deputy manager) of state supervision body on purpose of check to visit and inspect used by legal entities, physical persons, including individual entrepreneurs, when implementing economic and other activity on territory inland water transport, infrastructure facilities of inland water transport, court and other floating objects, to conduct necessary researches, testing, measurements, investigations, examinations and other actions for control;

To issue 3) to legal entities, physical persons, including individual entrepreneurs, instructions about elimination of the revealed violations of mandatory requirements, about holding actions for ensuring prevention of harm of life, to human health, the environment, property of physical persons or legal entities, the state-owned or municipal property, prevention of emergency situations of natural and technogenic nature;

4) to constitute protocols on administrative offenses, to consider cases on the specified administrative offenses and to take measures for their prevention;

To send 5) to authorized bodies the materials connected with violations of mandatory requirements for the solution of questions of initiation of legal proceedings on signs of crimes.";

e) add with Item 9 of the following content:

"9. The state supervision body according to the regulations on investigation of transport incidents on inland water transport approved by federal executive body in the field of transport performs investigation of transport incidents on inland water transport.";

e) add with Item 10 of the following content:

"10. The state supervision body provides supervision of activities of captains of pools of inland waterways for implementation of the state port control according to Article 38.1 of this Code.";

4) in Article 7:

a) state Items 2 and 3 in the following edition:

"2. The category of aids to navigation and terms of their work, the guaranteed dimensions of the ship courses, terms of operation of navigable hydraulic engineering constructions are established by the federal executive body performing functions on rendering the state services and management of state-owned property in the field of inland water transport, according to the procedure, established by the rules of content of inland waterways and rules of content of navigable hydraulic engineering constructions approved by federal executive body in the field of transport.

3. Pools of inland waterways are determined by federal executive body in the field of transport.";

b) in paragraph one of item 4 of the word "basin state bodies on inland water transport" shall be replaced with words "administrations of pools of inland waterways";

5) in Article 8:

a) in Item 1 of the word "basin state bodies on inland water transport" shall be replaced with words "administrations of pools of inland waterways";

b) in Item 2:

"basin state bodies on inland water transport" shall be replaced with words words "administrations of pools of inland waterways";
