About modification and amendments in the Law of the Republic of Tajikistan "About reference tribunals"

Article 1. Bring in the Law of the Republic of Tajikistan "About reference tribunals" of January 5, 2008 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2008, No. 1, h 2, the Art. 10) the following changes and amendments:

1. Add Article 4 with part 5 of the following content:

"5. If in the course of consideration of dispute by reference tribunal the legal relationship regulated by public methods are revealed, consideration of such dispute stops, and the parties are informed that they can take a legal action for the dispute resolution.".

2. Add the law with Article 4 (1) the following content:

"Article 4 (1). Cognizance of disputes to reference tribunals

The reference tribunal considers all disputes following from the civil and economic relations except disputes:

- about establishment of the facts having legal value;

- about protection of honor, advantage and goodwill;

- according to claims to resolutions of the bodies considering administrative disputes;

- about bankruptcy;

- about indemnification, the citizen caused to life and health;

- the disputes arising from heritable legal relationship;

- the disputes arising in case of civil registration;

- the disputes concerning procedure and conditions of marriage and annulment of marriage;

- the disputes concerning the property and personal non-property relations arising in family between spouses between parents and children, between other family members;

- the disputes arising in connection with adoption, guardianship and custody, acceptance of children on education;

- disputes on recognition of agreements by prisoners;

- housing disputes;

- the disputes concerning intellectual property;

- disputes on to which relation the legislation of the Republic of Tajikistan or the agreement of the parties establish other procedure for consideration.".

3. State Article 5 in the following edition:

"Article 5. Legislation of the Republic of Tajikistan on reference tribunals
