About modification of bases of the legislation of Ukraine on health care concerning establishment of restrictions for health and pharmaceutical workers during implementation of professional activity by them

The Verkhovna Rada of Ukraine decides:

1. To add the Section X of Bases of the legislation of Ukraine on health care (The sheet of the Verkhovna Rada of Ukraine, 1993 No. 4, of Art. 19 with subsequent changes) with Article 78-1 of such content:

"Article 78-1. The restrictions set for health and pharmaceutical workers during implementation of professional activity by them

Health and pharmaceutical workers during implementation of professional activity by them have no right:

To receive 1) from the subjects of managing enabling production and/or the realization of medicines, products of medical appointment, their representatives illegal benefit;

To receive 2) from subjects of managing which enable production and/or the realization of medicines, products of medical appointment, their representatives, samples of medicines, products of medical appointment for use in professional activity (except the cases connected with carrying out according to agreements of clinical trials of medicines or clinical testing of products of medical appointment);

3) to advertizes medicines, products of medical appointment, including to write out medicines on forms which contain information of advertizing nature and to specify producers of medicines (trademarks);

4) at the customer's request during realization (leave) of medicine not to grant or provide unreliable information about availability in this pharmaceutical institution of medicines with the same active ingredient (according to the international unlicensed name), to form of leave and dosing, in particular to hide information on availability of such medicines on the lowest price.

Provisions of this Item extend only to pharmaceutical workers.

Health and pharmaceutical workers bear responsibility for violation of requirements of this Article, stipulated by the legislation".

2. This Law becomes effective since August 1, 2012.
