About subsistence minimum

The Parliament adopts this organic law.

Section I. General provisions

Article 1. Purpose and scope of the law

1) This law establishes the legal base of regulation of the minimum state guarantees in the field of the income of the population in proportion to life cost for providing the adequate vital standard in implementation process of state policy in the social sphere.

(2) the Subsistence minimum is used in case of:

a) to overall assessment of level of living of the population and its primary social and demographic groups in implementation process of social policy;

b) reasons for need of change of the minimum wage and the minimum size of old-age pension, the minimum guaranteed monthly income of family, the sizes of grants, benefits and compensations.

(3) Use of subsistence minimum with specified in Item b) parts (2) the purpose it is regulated by the corresponding regulations taking into account financial opportunities of the country.

Article 2. Basic concepts

For the purposes of this law the following basic concepts are used:

subsistence minimum - the indicator representing cost assessment of the minimum amount of consumption of the material benefits and services necessary for satisfaction of basic needs, preserving health and maintenance of life activity of the person;

food basket - the minimum set of the foodstuff providing normal functioning of human body and preserving his health;

foodstuff - the products in the natural or processed type intended for the use by the person;

manufactured goods - material benefits, others than foodstuff which provides basic needs of the person;

the services rendered to the population - the types of activity and works aimed at providing life activity of people;

compulsory contributions - the fees of compulsory medical insurance and fees of compulsory national social insurance paid by physical persons;

persons are more senior than retirement age - persons who stepped for the retirement age necessary for receipt of pension entitlement on age according to the legislation.
