About refugees

This Law determines procedure and conditions of recognition of person by the refugee in Turkmenistan, its legal status, establishes legal, economic and social guarantees of protection of the rights of the refugee.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) the refugee – person who owing to quite reasonable concerns to fall victim of prosecutions on the basis of race, the veroyoispovedaniya, nationality, belonging to certain social group or political convictions is in Turkmenistan and cannot use protection of the country or does not wish to use such protection owing to such concerns; or, without having certain nationality and being out of the country of the former regular residence as a result of similar events, cannot or does not wish to return to it owing to such concerns;

2) the place of temporary residence – the place of stay of person who addressed with the petition for provision of the status of the refugee, and members of his family;

3) the certificate of the refugee – the document of the established sample proving the identity of person to whom the status of the refugee in Turkmenistan is provided;

4) the travel document of the refugee – the document of the established sample, the right to the departure from Turkmenistan granting to the refugee and entry into Turkmenistan;

5) the temporary certificate of registration of the petition for provision of the status of the refugee – the identity document and confirming legality of stay of person in the territory of Turkmenistan during consideration of the petition for provision of the status of the refugee;

6) the status of the refugee – the legal status of person recognized as the refugee in Turkmenistan, determined by the legislation of Turkmenistan.
