In connection with the introduction in action of the Customs code of Ukraine of 13.03.2012 No. 4495-VI (further - the Code) the State Customs Service of Ukraine takes measures concerning reduction of the Licensed conditions of carrying out intermediary activities of the customs broker approved by the order of the State committee of Ukraine concerning regulatory policy and entrepreneurship, the State Customs Service of Ukraine of 13.05.2009 No. 89/445, registered in the Ministry of Justice of Ukraine 29.05.2009 for No. 469/16485 (further - Licensed conditions) in compliance with requirements of the legislation of Ukraine.
According to Item 2 of the Section I of Licensed conditions the representative of the customs broker is physical person which is in employment relationships with the customs broker and directly carries out for the benefit of person whom the customs broker, the actions connected with presentation to customs authority of goods and vehicles, and also the documents necessary for their customs control and customs clearance which meets qualification requirements, stipulated in Item of the 10th Section II of Licensed conditions represents.
According to article 418 of the Code the customs clearance agent is physical person - the resident, kotoroyenakhoditsya in employment relationships with the customs broker and directly carries out for the benefit of person whom the customs broker, the actions connected with presentation to customs authority of goods, vehicles of commercial appointment, and also the documents necessary for implementation of their customs control and customs clearance represents.
