About modification of some legal acts of Ukraine concerning enhancement and simplification of the procedure of state registration of the parcels of land and corporeal rights to real estate

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383 with subsequent changes):

1) in Article 28:

to add part one after words of "notarial action" with words "implementation of functions of the state registrar of the rights to real estate according to the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings";

the second to add part with words of "functions of the state registrar of the rights to real estate";

in part four of the word "hundred fifty" to replace with the word "one thousand";

To add 2) with Article 46-1 of such content:

"Article 46-1. Powers of notaries in the field of state registration of the corporeal rights to real estate and their burdenings

The notary during making of notarial actions with real estate, object of construction in progress has access and uses the State register of the corporeal rights to real estate. The notary is special subject to whom functions of the state registrar of the rights to real estate according to the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings" are assigned and which has seal of such registrar.

Use of the State register of the corporeal rights to real estate is performed directly by the notary who makes the corresponding notarial action.
