About modification of some legal acts of Ukraine concerning participation in judicial session in the video conference mode

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Economic Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 1992, No. 6, the Art. 56):

To add 1) with Article 74-1 of such content:

"Stattya 74-1. Participation in judicial session in the video conference mode

The economic court on own initiative or according to the petition of the party, the third party, prosecutor, other participant of legal procedure can decide determination about their participation in judicial session in the video conference mode.

In the petition for participation in judicial session in the video conference mode the court in which it is necessary to provide its carrying out without fail is specified. Such petition can be submitted not later than in seven days prior to day of carrying out judicial session in which there will be such participation.

The issue of participation of person in judicial session in the mode of video conference is resolved by economic court in the presence of the corresponding petition or on own initiative not later than in five days prior to day of carrying out such judicial session. The determination of court accepted by results of the solution of this question is not subject to appeal.

Determination about participation of person in judicial session in the mode of video conference shall contain:

1) the name of court which is entrusted to provide carrying out video conference;

2) the name (for legal entities) or name (surname, name and middle name (in case of its availability) - for physical persons) person who will participate in judicial session in the video conference mode, and its procedural status;

3) date and time of carrying out judicial session.
