About modification of the Land code of Ukraine relatively about carrying out the land biddings in the form of auction

The Verkhovna Rada of Ukraine decides:

I. Article 135 - 139 Land codes of Ukraine (2002, 27) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 3-4, in such edition:

"Article 135. Land biddings

1. The land auction is held in the form of auction by results of which holding the contract of purchase sale, lease, superficies, emphyteusis of the parcel of land with the participant (winner) of the land biddings who offered the highest price for the parcel of land which is on sale, or the highest payment for use of it fixed during the land biddings is signed.

2. Sale of the parcels of land of the state-owned or utility property or the rights to them (leases, superficies, emphyteusis) is performed only at the land biddings, except the cases established by parts two and third Article 134 of this Code.

At the land biddings the privilege of purchase cannot be used.

Sale of the parcels of land of state-owned property together with the objects located on them which are subject to privatization at the land biddings is performed by state bodies of privatization according to the procedure, established by this Code, taking into account requirements of the legislation concerning privatization.

Sale of the parcels of land which are in private property or the rights to them (leases, superficies, emphyteusis) can be performed at the land biddings only at the initiative of owners of the parcel of land. In that case the land biddings are regulated by provisions of this Code if another is not provided by the law or the contract with the contractor of the land biddings.

The address of collection on the parcels of land or the rights to them (leases, superficies, emphyteusis) is performed by the state contractor during execution of decisions which are subject to forced execution according to the procedure, established by the Law of Ukraine "About enforcement proceeding", taking into account features of preparation for carrying out and carrying out the land biddings determined by this Code.
