About approval of the Instruction on clerical work according to addresses of citizens in the State inspection of agricultural industry of Ukraine

According to the Law of Ukraine "About the address of citizens", Article 1 of the Presidential decree of Ukraine of February 7, 2008 "About first-priority measures concerning ensuring realization and guaranteeing constitutional right on the appeal to public authorities and organ local self-government" and for the purpose of enhancement of work with addresses of citizens and the organization of personal reception of citizens in the office of the State inspectorate of agricultural industry of Ukraine I ORDER to No. 109:

1. Approve the Instruction on clerical work on addresses of citizens in the State inspection of agricultural industry of Ukraine which is applied.

2. To department of agriculture (Demidov O. A.) provide provision of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister Senya O. V.

The instruction on clerical work on addresses of citizens in the State inspection of agricultural industry of Ukraine

I. General provisions

1.1. This Instruction determines procedure for record keeping by addresses of citizens in the State inspection of agricultural industry of Ukraine.

1.2. This Instruction is developed according to the law of Ukraine "About the address of citizens", the Presidential decree of Ukraine of February 7, 2008 No. 109 "About first-priority measures concerning ensuring realization and guaranteeing constitutional right on the appeal to public authorities and local government bodies", the resolution of the Cabinet of Ministers of Ukraine of April 14, 1997 No. 348 "About approval of the Instruction on clerical work according to addresses of citizens in public authorities and local self-government, associations of citizens, at the companies, in organizations, the organizations irrespective of patterns of ownership, in mass media" (further - the Instruction on clerical work on addresses of citizens).

1.3. In this Instruction terms are used in the values given in the Law of Ukraine "About the address of citizens".

1.4. The clerical work according to addresses of citizens in the State inspection of agricultural industry of Ukraine (further - Inspection) is conducted separately from other types of clerical work and assigned to the sector of consideration and the analysis of appeals of Management of legal work of the State inspection of agricultural industry of Ukraine (further - the sector of consideration and the analysis of addresses).

The organization of clerical work for addresses of citizens in separate structural divisions of the office of Inspectorate (further - structural divisions of Inspection) is assigned to persons who are specially designated for this purpose (further - persons responsible for record keeping in structural divisions of Inspection).

1.5. Consideration of offers (notes), statements and claims of citizens, is carried out according to Articles 14, 15 and 16 Laws of Ukraine "About the address of citizens".

1.6. The procedure for record keeping is determined by addresses of citizens which contain the data which are the state secret protected by the law by regulatory legal acts.

1.7. The personal liability for the organization and condition of clerical work for addresses of citizens is born by the Chairman of the State inspection of agricultural industry of Ukraine.

II. Registration, accounting and preliminary consideration of addresses of citizens

2.1. The address can be oral (the stated citizen and the written-down official of Inspection on personal acceptance) or written (the citizen sent by mail or transferred personally or through person authorized by it if these powers are drawn up according to the current legislation, in Inspection or on personal acceptance to the official of Inspection).

The address can be submitted both by the individual (individual), and group of persons (collective).

2.2. Addresses of citizens shall be drawn up with observance of the requirements provided by parts two and the fifth article 5 of the Law of Ukraine "About the address of citizens".

The addresses which are drawn up without observance of the specified requirements return to applicants with the corresponding explanations not later than in ten days from the date of its receipt, except the cases provided by part one of article 7 of the Law of Ukraine "About the address of citizens" in time.

2.3. The written address without specifying of the place of residence which is not signed by the author (authors) and also it from which it is impossible to establish authorship is recognized anonymous and is not subject to consideration. Also repeated addresses from the same citizen on the same question are not considered if the first is solved in essence, and also those addresses which terms of consideration are stipulated in Article 17 Laws of Ukraine "About the address of citizens", and addresses of persons recognized by court incapacitated.

The decision on the termination of consideration of such address is made by the Chairman of the State inspection of agricultural industry of Ukraine.

2.4. Registration of appeals of citizens to Inspectorates is carried out for the purpose of ensuring their accounting and control of their consideration.

2.5. All addresses of citizens which arrive in Inspection are subject to obligatory classification by their types according to article 3 of the Law of Ukraine "About the address of citizens", namely: offers, statements and claims.

2.6. All addresses of citizens which arrive in Inspection are registered centralized the sector of consideration and the analysis of addresses:
