About modification and amendments in some legal acts

Ct.I. - In the Law on procedure for compensation of the damage caused by illegal actions of criminal prosecution authorities, prosecutor's office and degrees of jurisdiction No. 1545-XIII of February 25, 1998 (Official monitor of the Republic of Moldova, 1998, No. 50-51, of the Art. 359), with subsequent changes, to make the following changes and additions:
1. Part (Article 5 to add 1) with the offer of the following content: "The body representing the state in degree of jurisdiction on this category of cases is the Ministry of Justice.".
2. Add the law with Article of 131 following contents:
"Art. 131. - (1) the Judgment on compensation of the damage caused by illegal actions of criminal prosecution authorities, prosecutor's office and degrees of jurisdiction is performed in the procedure established by the current legislation after its introduction in legal force.
(2) the Degree of jurisdiction on the initiative shows to execution to the Ministry of Justice the writ of execution issued based on the judgment which took legal effect and notifies on it the parties. Upon the demand of the Ministry of Justice the creditor submits the bank details necessary for execution of writ of execution within five-day term. The writ of execution issued based on the decision which took legal effect can be shown to execution to the Ministry of Justice also by the creditor, with appendix of necessary bank details for transfer implementation.
(3) In ten-day time from the date of receipt of the writ of execution issued based on the judgment which took legal effect, the Ministry of Justice sends it to the Ministry of Finance together with judgments on the corresponding case and bank details of the creditor.
(4) the Writ of execution is performed by the Ministry of Finance according to the procedure and in the terms established by the Law on budget system and budget process No. 847 - XIII of May 24, 1996.".
