About modification of some legal acts of Ukraine concerning functioning of payment systems and development of clearing settlements

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In article 7 of the Law of Ukraine "About the National Bank of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1999 No. 29, Art. 238 with subsequent changes):

state Item 7 in such edition:

"7) determines the directions of development of modern electronic banking technologies, creates and provides continued, reliable and effective functioning, development of the payment and accounting systems created by it, controls creation of payment instruments, systems of automation of banking activity and remedies of bank information";

add with Items 25 - 27 following contents:

"25) the procedure in Ukraine determines routings, clearing and settlement between members of payment service provider by the transactions performed within Ukraine using the payment cards emitted by resident banks;

26) is created by the Zaveritelny center for ensuring registration, certification of action of open keys and accreditation of the centers of certification of keys, determines procedure for application of the digital signature, including digital signature in bank system of Ukraine and subjects of money transfer;

27) grants licenses to non-bank financial institutions which intend to become members of payment service providers, on money transfer without opening of accounts and recalls them according to the legislation".

2. In the Law of Ukraine "About payment systems and money transfer in Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2001 No. 29, Art. 137; 2005 No. 1, Art. 23):

Preamble to state 1) in such edition:

"This Law determines the general principles of functioning of payment systems and settlement systems (further - payment systems) in Ukraine, the concept and general procedure for carrying out money transfer within Ukraine, establishes responsibility of subjects of transfer, and also determines general procedure of supervision (oversight) of payment systems";
