About features of completion of customs procedure of customs transit concerning the goods following to Authorized Economic Operator
In connection with the appeals of customs authorities and participants of foreign economic activity arriving in FCS of Russia concerning practical application of features of movement of goods according to customs procedure of customs transit from customs authority of the Russian Federation in the place of arrival to internal customs authority of the Russian Federation, and also between internal customs authorities of the Russian Federation road transport to Authorized Economic Operator (further - UEO), we explain the following.
According to article 41 of the Customs Code of the Customs Union (further - the Code) and article 86 of the Federal Law of 27.11.2010 N 311-FZ "About customs regulation in the Russian Federation" (further - the Law) one of the special simplifications provided to UEO is completion of customs procedure of customs transit concerning the goods following to UEO in case of their import to the Russian Federation according to part 3 of article 87 of this Law.
Part 4 of article 86 of the Law provides that as feature of customs transit of foreign goods from customs authority in the place of arrival to internal customs authority according to the paragraph the fourth Item 3 of article 215 of the Code is the possibility of delivery of the foreign goods following to UEO, to rooms, on the open areas and other territories of UEO having the status of the customs control zone and being in the region of activities of customs authority of appointment, without delivery of the specified goods to the location of customs authority of appointment. At the same time according to part 6 of this article of the Law the above-stated features are not applied in case of the customs transit of foreign goods performed according to the international treaties which are directly determining that delivery location of goods is the customs authority.
