About measures for ensuring calculations for the consumed imported natural gas

For the purpose of increase in responsibility of subjects of managing which make transport and deliver heat energy, for timeliness of calculations for the used gas and ensuring stable passing of the heating period of 2012/13 the Cabinet of Ministers of Ukraine decides:

1. To Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city public administrations:

it is urgent to provide representation to the Ministry of Regional Development, Construction and Housing and National joint stock company "Neftegaz of Ukraine" by the accepted territorial commissions on debt repayment of the companies of fuel and energy complex formed according to the resolution of the Cabinet of Ministers of Ukraine of February 22, 2006 No. 190 "About formation of the Interdepartmental commission on debt repayment of the companies of fuel and energy complex" (The Official Bulletin of Ukraine, 2006, No. 8, the Art. 447) (the territorial commissions are farther), decisions (the approved protocols) on approval of amounts of debt on difference in rates for heat energy which was made, transported and delivered to the population, the actual cost of heat energy which arose in connection with discrepancy to rates, which affirmed and/or approved by public authorities or local self-government (dalsherazniyets in rates), during the period from January 1, 2011 to October 1, 2012 and remained outstanding condition for October 1, 2012, by subjects of managing which make, transport and deliver heat energy for the population, expected according to the resolution of the Cabinet of Ministers of Ukraine of June 11, 2012 No. 517 "About approval of the Procedure and conditions of provision in 2012 of subvention from the government budget to local budgets debt repayment on difference in rates for heat energy, services in centralized water supply and drainage system which were made, transported and delivered to the population which arose in connection with discrepancy of actual cost of heat energy and services in centralized water supply and drainage system to rates, which affirmed and/or approved by public authorities or local self-government" (The Official Bulletin of Ukraine, 2012, No. 44, the Art. 1705) and approved with public authority or local self-government which approved the specified rates;

provide till November 1, 2012 accounting of the difference in rates determined by the paragraph the second this Item, and also separate accounting of difference in rates which is formed during the period from October 1, 2012 to December 31, 2012 which amounts are determined and approved according to the resolution of the Cabinet of Ministers of Ukraine of June 11, 2012 No. 517 and are approved with public authority or local self-government which approved the specified rates, with representation monthly to the 5th to the Ministry of Regional Development, Construction and Housing and National joint stock company "Neftegaz of Ukraine" of relevant decisions (the approved protocols) of the territorial commissions on approval of amounts of debt on difference in rates by subjects of managing.

2. To provide to the ministry of regional development, construction and housing and communal services representation of registers of decisions to the Ministry of Finance (the approved protocols) of the territorial commissions on approval of amounts of debt on difference in the rates given according to the paragraph to the second Item 1 of this resolution, and monthly to the 10th - decisions (the approved protocols) of the territorial commissions on approval of amounts of debt on difference in the rates given according to the paragraph to third Item 1 of this resolution by administrative and territorial units.

3. National joint stock company "Neftegaz of Ukraine" to perform supply of natural gas deliver to subjects of managing which make and transport heat energy, it is exclusive within the allocated limits on condition of ensuring absolute calculations for the natural gas consumed in last periods of the current year with them except for outstanding amounts which resulted from difference in rates according to the decisions (approved by protocols) of the territorial commissions about approval of amount of debt on difference in the rates given according to Item 1 of this resolution.

4. To the ministry of regional development, construction and housing and communal services and Ministry of Finance:

provide entering of corresponding changes into the Law of Ukraine "About the Government budget of Ukraine for 2012" concerning financing of difference in rates for heat energy for the population taking into account registers of decisions (the approved protocols) of the territorial commissions on approval of amounts of debt on difference in the rates given according to Item 2 of this resolution;

annually since 2012 to provide the mechanism of compensation of difference in rates which arises in connection with approval by the National commission performing state regulation in the field of utilities, rates for heat energy for the population at the level which does not cover economically reasonable planned expenses on production of heat energy taking into account the planned profit.

5. In full to provide to Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations till November 1 of the current year carrying out calculations of subjects of managing which make transport and deliver heat energy for the population, for the natural gas consumed in the last periods of the current year.
