About introduction of amendments to article 4 of the Law on temporary disability benefits and other benefits of social insurance No. 289-XV of July 22, 2004

Based on the Resolution of the Constitutional court No. 5 of April 10, 2012 about check of constitutionality of provisions of Items a) and b) parts (2) Articles 4, parts (1) Article 9 and Item c) parts (1) article 13 of the Law No. 289-XV of July 22, 2004 on temporary disability benefits and other benefits of social insurance, with subsequent changes and amendments,

The Parliament adopts this organic law.

Art. I. - In part (2) article 4 of the Law on temporary disability benefits and other benefits of social insurance No. 289-XV of July 22, 2004 (The official monitor of the Republic of Moldova, 2004, No. 168-170, of the Art. 773), with subsequent changes: Items and) and b) state in the following edition:

"a) the first, second and third calendar day of temporary disability is paid from financial resources of the employer, and in case of the unemployed - from budget funds of the national social insurance;

b) since fourth calendar day of temporary disability the benefit from budget funds of the national social insurance is paid.";

c) to declare Item invalid.

Art. II. - The allowances granted for the periods of temporary disability after April 10, 2012 are reviewed in accordance with the terms of this law.
