About modification of some legal acts of Ukraine concerning agreement performance about distribution of products

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about subsoil (The sheet of the Verkhovna Rada of Ukraine, 1994 No. 36, the Art. 340):

After the words "Provisions of Special Permissions to Use of Natural Resources" to add 1) to article 16 parts three through word comma "except cases of use of natural resources on the terms of the agreements on distribution of products signed according to the Law of Ukraine "About agreements on distribution of products";

2) in Article 24:

the fourth to add part with two offers of the following content: "Such consent or refusal in its provision shall be provided within twenty calendar days after receipt of the corresponding written request. In case of failure to provide any answer during the specified time such consent is considered provided";

add with part five of the following content:

"In case of obtaining by the investor under the agreement on distribution of products of refusal of the subsoil user in provision of consent to work within the mountain branch provided to such subsoil user for mining except mountain branches for production of stone and brown coal, anthracite and iron metal ores, irrespective of the bases for such refusal, such consent can be provided by specially authorized central executive body on industrial safety, labor protection, the state mountain supervision and state regulation in the field of safe handling of explosive materials of industrial function provided that simultaneous use of natural resources by several subsoil users within one mountain branch will not create threat of life and to human health and will not do harm to the subsoil and/or industrial facilities placed within the specified mountain branch".
