About modification of some legal acts of Ukraine in connection with adoption of law of Ukraine "About legal status of foreigners and stateless persons"

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of administrative legal proceedings of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2005, Art. No. No. 35-37, 446):

Part one of Article 18 to add 1) with Item 6 of such content:

"6) administrative cases of rather forced return to country of source or the third country and exclusion of foreigners and stateless persons out of limits of the territory of Ukraine";

2) parts the first, second and fourth Article 183-5 to state in such edition:

"1. Actions for declaration of foreigners and stateless persons concerning appeal of decisions on their forced return to country of source or the third country, and also actions for declaration of the central executive body which provides realization of state policy in the field of migration of bodies of protection of frontier or the Security Service of Ukraine about exclusion of foreigners and stateless persons out of limits of the territory of Ukraine move in administrative court on the location of the central executive body which provides realization of state policy in the field of migration, body of protection of frontier or the Security Service of Ukraine or on the location of Item of temporary stay of foreigners and stateless persons which illegally are in the territory of Ukraine.

2. The administrative cases provided by part one of this Article are considered by court in five-day time from the date of receipt of the action for declaration";

"4. Copies of judgments in the administrative cases determined by this Article instantly are issued to persons who took part in case";

3) in Article 256:

9 parts one to exclude Item;

the second to add part with Item 5 of such content:

"5) about exclusion of the foreigner or stateless person".
