About introduction of amendments to some resolutions of plenum of the Supreme Economic Court of Ukraine

According to Item "About judicial system and the status of judges" the plenum of the Supreme Economic Court of Ukraine DECIDES: 6 parts two of article 36 of the Law of Ukraine

Due to the changes which happened in the Economic Procedure Code of Ukraine, and questions which arose in court practice concerning application of regulations of substantive and procedural law by economic courts, to make changes to such resolutions of plenum of the Supreme Economic Court of Ukraine.

1. Actually ceased to be valid in connection with loss of force of the Resolution of the Supreme Economic Court of Ukraine of 11.10.2010 No. 2, in which made changes

2. Third subitem 2.8 of Item 2 of the resolution of plenum of the Supreme Economic Court of Ukraine of 17.05.2011 No. 6 "About some questions of practice of hearing of cases in disputes which arise" to exclude the paragraph from land relations.

3. In the resolution of plenum of the Supreme Economic Court of Ukraine of 17.05.2011 No. 7 "About some questions of practice of application of the Section XII of the Economic Procedure Code of Ukraine":

3.1. Add Item 5-1 with the paragraph of such content:

"Determinations about return appeal and writs of appeal in the given cases it can be taken out by Appeal Court and in case of lack in it of case papers, - based on the this clerical work of court and the Unified state register of judgments";

3.2. The two first the offer of Item 10 to replace with one offer of such content: "Effects of submission of petitions for appeal on determinations of local economic court which are not subject to appeal separately from the judgment are determined by part two of article 106 HPK".
