About modification and amendments in the law of the Kyrgyz Republic "About licensing"

Article 1. Bring in the Law of the Kyrgyz Republic "About licensing" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1997, No. 3, the Art. 126) the following changes and amendment:

"Article 17-3. Procedure for execution of the license in case of violation of term of issue or refusal in licensing by the licensing body
1. The licensing body shall notify in the terms established for licensing the applicant on decision making about issue or about refusal in licensing.
The notification on issue or on refusal in licensing goes (is handed) to the applicant in writing.
2. If the licensing body did not grant to the applicant the license or in writing did not notify on cause of failure in licensing, within thirty calendar days from expiry date, established for licensing, the applicant in writing notifies the relevant licensing organ on the beginning of implementation of the type of activity declared to them.
The licensing body no later than thirty calendar days from the moment of receipt of the written notice of the applicant shall grant the license which action begins with the date specified by the applicant in the written notice.
3. Decisions of authorized body in the field of subsurface use are made according to the legislation of the Kyrgyz Republic on subsoil.".
4. State Article 18 in the following edition:
"Article 18. Appeal of refusal in licensing
If the refusal in licensing is represented to the applicant unreasonable, he has the right to appeal these actions judicially.".
