1. Approve the Procedure for issue of the certificate on the admission of the road vehicle to transportation of goods under customs seals and seals which is applied.

2. Declare invalid the order of the State Customs Service of Ukraine of January 27, 2011 No. 59 "About approval of the Procedure for issue of certificates on the admission of the road vehicle to transportation of goods under customs seals and seals", registered in the Ministry of Justice of Ukraine on February 22, 2011 for No. 218/18956.

3. (Chmeruk M. O.) and to Department of the organization of customs control and registration of the State Customs Service of Ukraine (Syomk S. M.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

4. To department of customs information technologies and statistics (Yurchenko K. G.) develop and put into operation programmnoinformatsionny complex on forming of the magazine of registration of issue of the certificate of compliance and assignment of registration number to the certificate of compliance in the Single automated system of State Customs Service and application of its data in the corresponding program and information complexes when implementing issue of the certificate of compliance.

5. Determine that this order becomes effective in 45 days from the date of its official publication.

Procedure for issue of the certificate on the admission of the road vehicle to transportation of goods under customs seals and seals

І. General provisions

1.1. This Procedure is developed for the purpose of determination of the sequence of actions of officials of customs authorities during issue of the certificate on the admission of the mechanical road vehicle, trail car, the semitrailer truck intended for its towage by such vehicle (further - TS) which owner performs motor transportations on the terms of the Customs convention about international delivery of loads using the book of MDP 1975 (further - the Convention MDP), to transportation of goods under customs seals and seals.

1.2. In this Procedure terms are used in such value:

the owner of the CU - legal entity or physical person - the entrepreneur to whom the TS belongs on the property right or uses;

the applicant - the owner of TS or person which is properly authorized by it;

customs authority of issue - customs authority which performs issue of the certificate on the admission of the road vehicle to transportation of goods under customs seals and seals in which zone of activities this owner of TS is located (on the location of the legal entity or in the place of residence of physical litsapredprinimatel);

The certificate on the admission of the road vehicle to transportation of goods under customs seals and seals (dalshesvidetelstvo about the admission) - the document which sample is given in appendix 4 to the Convention MDP which certifies compliance of the cargo compartment of the automotive vehicle to the international technical requirements established by the Convention MDP.

1.3. The certificate on the admission is granted only on TS which cargo compartments comply with the international technical requirements which are determined in appendix 2 to the Convention MDP (the international technical requirements are farther).

1.4. The certificate on the admission is granted by customs authority of issue to the owner of TS within one working day (but not later than the next working day) after provision of complete document package and representation of TS to survey.

1.5. Survey of TS is performed in the place determined by the order of customs authority of issue, officials of customs authority of issue to whom functions of implementation of customs control in case of the admission of TS to transportations of goods under customs seals and seals are assigned.

1.6. According to the decision of the head of customs authority of issue or person authorized by it survey of TS can be performed in the territory of the company or in the place determined in the statement of the owner by TS on condition of provision of the corresponding statement by it in such cases:

registration of significant amount of TS (it is more than 10);

considerable distance from the TS parking lot to the locations of divisions of customs authority of issue to which officials functions of implementation of customs control in case of the admission of TS to transportations of goods under customs seals and seals are assigned;

impossibility of representation of TS to the place determined by the order of customs authority of issue for implementation of its survey in connection with technical restrictions (the restrictions connected with dimensions of TS, and so forth).
