About modification and amendments in some legal acts

This law provides partial transposition of the Directive of Council 2004/81/EU of April 29, 2004 about the residence permit issued to citizens of the third countries which are the victims of human trafficking or were subject to the actions directed to assistance of illegal immigration and which cooperate with competent authorities.

The Parliament adopts this organic law.

Art. I. - Part (3) article 4 of the Law on the state fee No. 1216-XII of December 3, 1992 (repeated publication: 2004, No. 53-55, of the Art. 302), with subsequent changes to add the official monitor of the Republic of Moldova with Item 8) of the following content:

"8) foreigners who are or were the victims of human trafficking, - for consideration of the application about provision or prolongation of the right to temporary stay and for issue of the corresponding residence permit.".

Art. II. - In the Law on the prevention and suppression of human trafficking No. 241-XVI of October 20, 2005 (Official monitor of the Republic of Moldova, 2005, No. 164-167, of the Art. 812), with subsequent changes, to make the following changes and additions:

1. Add the law with the following preamble:

"This law provides partial transposition of the following acts:

The convention of the Council of Europe on counteraction to human trafficking of May 3, 2005;

The United Nations Convention Against Transnational Organized Crime of November 15, 2000;

The framework decision of Council 2002/629/JAI of July 19, 2002 about fight against human trafficking;

The framework decision of Council 2001/220/JAI of March 15, 2001 about the status of the victims in criminal procedure;

The directive of Council 2004/81/EU of April 29, 2004 about the residence permit issued to citizens of the third countries which are the victims of human trafficking or were subject to the actions directed to assistance of illegal immigration and which cooperate with competent authorities.".
