About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, No. 7274, of the Art. 195), with subsequent changes to make the following changes and additions:
1. Part (Article 13 to add 2) with words ", but only in the absence of serious reasons to believe that they risk to be subject to capital punishment, tortures either another brutal or to degrading treatment.".
2. Part (articles 60 after the words "war crimes" to add 8) with words ", the crimes connected with tortures, brutal or degrading treatment".
3. Part (Article 65 to add 2) with words ", and in the cases which are directly provided by the Special part of this Code for a period of 1 year up to 15 years.".
4. In part (Article 79 of the word "or in case of recurrence of crimes." shall be replaced with words 4) ", in case of recurrence of crimes or in case of making of the crimes provided by parts (2) - (4) Article 1661.".
5. Add Article 107 with part (3) the following content:
"(3) Amnesty is not applied in case of making of the crimes provided by parts (2) - (4) Article 1661.".
6. Item e) parts (Article 151 to state 2) in the following edition:
"e) with special cruelty, and also from sadistic motives;".
7. Item f) parts (Article 152 to state 2) in the following edition:
"f) with special cruelty, and also from sadistic motives;".
8. In Item g) parts (Article 165 of the word "using tortures, brutal or degrading treatment" shall be replaced with words 2) "with special cruelty".
9. Add the code with Article 166-1 of the following content:
"Article 166-1. Tortures, brutal or degrading treatment
(1) the Intentional causing pain or physical or mental suffering representing brutal or degrading treatment, the public figure or person which is actually performing functions of public organization or any other person acting in official quality or from permission or acquiescence of specified persons
