About some measures for enhancement of lawyer and notarial activities in the Republic of Belarus

For the purpose of creation of proper conditions for realization by each citizen of the right to legal aid and according to part three of article 101 of the Constitution of the Republic of Belarus I DECIDE:

1. Determine that:

1.1. special permissions (licenses) (further - licenses) on implementation of lawyer and private notarial activities are issued by the Ministry of Justice to citizens of the Republic of Belarus under condition:

passing qualification examination of the relevant commission created by the specified Ministry from among representatives of state bodies, lawyers (notaries), other specialists in the field of the right. Commission chairman is the deputy minister of justice;

payments of the license fees established by legal acts;

that persons applying for receipt of the license from the date of filing of application about the admission to qualification examination about day of receipt of the corresponding license did not hold positions on which operating time is set off in service length in the state apparatus;

observance of other requirements of the legislation which are not contradicting this Decree;

1.2. licenses for implementation of lawyer and private notarial activities are issued for the term of at least five and no more than ten years.

Prolongation of effective period of the license is made by the Ministry of Justice according to the statement of the licensee taking into account observance of the legislation on lawyer (notarial) activities for results of the certification which is carried out by the relevant Bar (The Belarusian notarial chamber) by it;
