About approval of the Procedure for representation by the organizations of the notifications represented when purchasing ethyl alcohol for production of alcoholic and alcohol-containing products and (or) use for own needs and also by delivery and transportation of ethyl alcohol (including denatured alcohol), not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods, and forms of notifications

According to Item 5 of article 9 of the Federal Law of November 22, 1995 N 171-FZ "About state regulation of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and about restriction of consumption (drinking) of alcoholic products" (The Russian Federation Code, 1995, N 48, Art. 4553; 1999, N 2, Art. 245; 2001, N 53, Art. 5022; 2002, N 30, Art. 3026, 3033; 2004, N 45, Art. 4377; 2005, N 30, Art. 3113; 2006, N 31, Art. 3433; N 43, of Art. 4412; 2007, N 1, Art. 11; N 17, of Art. 1931; N 31, of Art. 3994; N 49, of Art. 6063; 2008, N 30, Art. 3616; 2009, N 1, Art. 21; N 52, of Art. 6450; 2010, N 15, Art. 1737; N 31, of Art. 4196; 2011, N 1, Art. 42; N 27, of Art. 3880; N 30, of the Art. 4566, 4601), subitems 5.2.1 and 5.2.2 of the Regulations on Federal Service for Alcohol Market Regulation approved by the order of the Government of the Russian Federation of February 24, 2009 N 154 "About Federal Service for Alcohol Market Regulation" (The Russian Federation Code, 2009, N 9, Art. 1119; 2012, N 7, the Art. 852), and for the purpose of realization of Item 9 of article 1 of the Federal Law of July 18, 2011 N 218-FZ "About introduction of amendments to the Federal law "About State Regulation of Production and Turnover of Ethyl Alcohol, Alcoholic and Alcohol-containing Products" and separate legal acts of the Russian Federation and recognition voided the Federal Law "About the Restrictions of Retail Sale and Consumption (Drinking) of Beer and Drinks Made on Its Basis" (The Russian Federation Code, 2011, N 30, 4566) I order to the Art.:

1. Approve the Procedure for representation by the organizations of the notifications represented when purchasing ethyl alcohol for production of alcoholic and alcohol-containing products and (or) use for own needs and also by delivery and transportation of ethyl alcohol (including denatured alcohol), not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods according to the Appendix N 1 to this order.

2. Approve form of the notification confirming purchase of ethyl alcohol (including denatured alcohol) and not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods according to the Appendix N 2 to this order.

3. Approve form of the notification confirming supply of ethyl alcohol (including denatured alcohol) and not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods according to the Appendix N 3 to this order.

4. Approve form of the notification confirming transportation of ethyl alcohol (including denatured alcohol) and not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods according to the Appendix N 4 to this order.

5. Recognize invalid the following orders of Federal Service for Alcohol Market Regulation:

1) the order of March 29, 2010 N 25 N "About approval of the Procedure for representation by the organizations of the notifications represented when purchasing ethyl alcohol for production of alcoholic and alcohol-containing products and (or) use for own needs and also by supply of ethyl alcohol, not packed up alcohol-containing products with content of ethyl alcohol more than 60 percent of amount of finished goods, and forms of notifications" (it is registered by the Ministry of Justice of the Russian Federation on July 6, 2010, registration N 17700);

2) the order of September 1, 2010 N 51 N "About introduction of amendments to the order of Federal Service for Alcohol Market Regulation of March 29, 2010 N 25 N" (it is registered by the Ministry of Justice of the Russian Federation on October 11, 2010, registration N 18682).

6. To impose control of execution of this order on the deputy manager of Federal Service for Alcohol Market Regulation V. L. Didenko.

Appendix №1

Procedure for representation by the organizations of the notifications represented when purchasing ethyl alcohol for production of alcoholic and alcohol-containing products and (or) use for own needs and also by delivery and transportation of ethyl alcohol (including denatured alcohol), not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods

1. This procedure determines representation by the organizations of the notifications confirming purchase (including for own needs), delivery, transportation of ethyl alcohol (including denatured alcohol) and not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods (further - notifications).

2. The organizations conducting procurement of ethyl alcohol in the amount exceeding 200 decalitres a year for the purpose of production of ethyl alcohol under pharmacopoeian Articles, alcoholic and alcohol-containing products and also on the technical or other purposes which are not connected with production of the specified products; ethyl alcohol under pharmacopoeian Articles in the amount exceeding 200 decalitres a year for the purpose of its use as medicine and (or) for production of the medicines included in the state register of medicines and (or) uses for own needs; not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods, represent the notification in form according to the appendix N 2 to this order to interregional management of Federal Service for Alcohol Market Regulation on the federal district (further - territorial authority) in the place of the stay.

3. The organizations performing supply of ethyl alcohol (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods, represent the notification in form according to the appendix N 3 to this order to territorial authority in the place of the stay.

In case of transfer of ethyl alcohol by the organization (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods to the separate division, the organization represents the notification in form according to the appendix N 3 to this order to territorial authority in the place of the stay and the notification in form according to the appendix N 2 to this Order in territorial authority in the location of the specified separate division.

The organization performing transfer of ethyl alcohol (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods between the separate divisions, represents notifications in form according to the appendices N 3 and N 2 to this order to territorial authorities respectively in the location of the specified separate divisions.

4. The organization transporting (including to the separate division or between the separate divisions) ethyl alcohol (including denatured alcohol) and not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods, represents the notification in form according to the appendix N 4 to this order to territorial authority in the place of the stay.

5. Notifications are represented by the organization before purchase implementation (transfer for own needs) ethyl alcohol (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods; before implementation of supply of ethyl alcohol (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods; before implementation of transportation of ethyl alcohol (including denatured alcohol) and (or) not packed up alcohol-containing products with content of ethyl alcohol more than 25 percent of amount of finished goods on each batch which is purchased, delivered and the transported products separately.

The lot of products is meant as amount of the products which are purchased (transferred), delivered or transported by one organization of one name, type and date of purchase (transfer), delivery or transportation.

The type of the purchased, delivered, transported products is specified according to article 2 of the Federal Law of November 22, 1995 N 171-FZ "About state regulation of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and about restriction of consumption (drinking) of alcoholic products", including with indication of volume fraction of ethyl alcohol as a percentage.

4. The notification can be provided by the organization by proxy in accordance with the established procedure of the representative of the organization or is directed in the form of the mailing with the inventory of investment.

In case of submission of the notification by proxy in accordance with the established procedure of the representative of the organization the territorial authority has no right to refuse adoption of the notification and shall give on the copy of the notification mark about date of its acceptance.
