About provision of free secondary legal assistance
By the law of Ukraine "About free legal assistance" which became effective on July 9, 2011 it is determined that persons to whom administrative detention is applied have the right to free secondary legal assistance.
According to Article 507 of the Customs code of Ukraine for the purpose of the termination of customs offense, establishment of person which made customs offense and also for creation of the protocol on customs offense if it it is impossible to constitute on site making of offense, administrative detention of person which made such violation, for up to three hours is allowed.
The resolution of the Cabinet of Ministers of Ukraine No. 1363 approves of 28.12.2011 the Procedure for informing the centers for provision of free secondary legal assistance on cases of detention of persons.
By the specified procedure it is determined that after the actual detention of person the official of the subject of submission of information immediately reports by means of telephone, facsimile bonds, e-mail or through special information and communication systems to the relevant center for provision of free secondary legal assistance such data:
surname, name, middle name of the detained person (if they are known);
time and bases of detention of person;
the exact address of the place for confidential appointment of the lawyer to the detained person;
name of the subject of provision of information, its postal address, phone numbers and e-mail address;
surname, name, middle name and position of person who transferred the message.
The Ministry of Justice of Ukraine the order No. 968/5 forms of 02.07.2012 republican, the regional and city centers for provision of free secondary legal assistance in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol.
