About introduction of amendments to some acts of the President of the Russian Federation concerning military and technical cooperation of the Russian Federation with foreign states

For the purpose of further enhancement of state regulation in the field of military and technical cooperation of the Russian Federation with foreign states I decide:

1. Bring in Item 9 of the Regulations on Federal Service for Military-Technical Cooperation approved by the Presidential decree of the Russian Federation of August 16, 2004 N 1083 "Questions of Federal Service for Military-Technical Cooperation" (The Russian Federation Code, 2004, N 34, Art. 3539; N 43, of Art. 4189; 2005, N 13, Art. 1137; N 49, of Art. 5202; 2007, N 52, Art. 6425; 2008, N 15, Art. 1527; N 49, of Art. 5764; N 50, of Art. 5901; 2009, N 1, Art. 93; 2011, N 3, Art. 523; N 21, of Art. 2925; N 31, of Art. 4708; 2012, N 3, Art. 405; To N 38, of the Art. 5071), change, having stated the paragraph the fourth subitem 2 in the following edition:

"about provision in accordance with the established procedure under authorization of the President of the Russian Federation to the organizations - developers and producers of military products of the right to implementation of foreign trade activity concerning military products in the part concerning spare parts supplies, aggregates, nodes, devices, components, special, educational and auxiliary property, technical documentation to earlier delivered military products, works on survey, calibration, prolongation of useful life, maintenance, repair (including with the upgrade assuming carrying out research and development works), utilization and other works providing complex field service of earlier delivered military products, training of foreign specialists in carrying out the specified works participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair and destruction (utilization) of military products, creation and additional equipment in the territory of foreign states of objects, providing complex field service of the delivered military products, and also import of the military products necessary for production of own military products; about deprivation in accordance with the established procedure the called organizations of the specified right;".

Bring in Regulations on procedure for provision to the Russian organizations of the right to the implementation of foreign trade activity concerning military products approved by the Presidential decree of the Russian Federation of September 10, 2005 N 1062 "Questions of military and technical cooperation of the Russian Federation with foreign states" (The Russian Federation Code, 2005, N 38, Art. 3800; 2007, N 52, Art. 6425; 2008, N 49, Art. 5764; N 50, of Art. 5901; 2009, N 42, Art. 4917; N 50, of Art. 6074; 2011, N 21, Art. 2925; N 31, of Art. 4708; N 44, of Art. 6241; N 48, of Art. 6881; N 49, of Art. 7264; 2012, N 3, Art. 405; N 13, of Art. 1487; N 32, of Art. 4483; N 41, of the Art. 5583), following changes:

a) to "carrying out the specified works" to add the subitem "v" of Item 2 after words with words "; participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair and destruction (utilization) of military products, creation and additional equipment in the territory of foreign states of objects, providing complex field service of the delivered military products, and also import of the military products necessary for production of own military products";

b) state Item 5 in the following edition:

"5. Decisions on provision to the organizations of the right to implementation of foreign trade activity concerning military products and about deprivation of such right are accepted by the President of the Russian Federation on representation of the Government of the Russian Federation.

Decisions on provision to the organizations of the right to implementation of foreign trade activity concerning the military products provided by the subitem "v" of Item 2 this provision can be accepted by Federal Service for Military-Technical Cooperation under authorization of the President of the Russian Federation. The decision on authorization of Federal Service for Military-Technical Cooperation is made in the form of the order of the President of the Russian Federation on several organizations for representation of the Government of the Russian Federation. The decision on deprivation in accordance with the established procedure of the organizations of the specified right is made by Federal Service for Military-Technical Cooperation.

The decision on provision of the organization of the right to implementation of foreign trade activity is made on military products according to the specific nomenclature (list) of these products which are subject of productive activity of the organization which can join only the military products specified in the list of the military products permitted to transfer to foreign customers (further - the list N 1). Authorized bodies and subjects of military and technical cooperation of foreign states, and also the international organizations representing the interests of foreign states can act as foreign customers.

By provision of the organization of the right to implementation of foreign trade activity in the part concerning participation in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair and destruction (utilization) of military products, creation and additional equipment in the territory of foreign states of objects, providing complex field service of the delivered military products, and also import of the military products necessary for production of own military products the decision is made on military products proceeding from subject of productive activity of the organization.

The right to implementation of foreign trade activity concerning military products is granted for term, as a rule, not exceeding five years.".

Bring in Item 1 of the Presidential decree of the Russian Federation of January 18, 2007 N 54 "About some questions of military and technical cooperation of the Russian Federation with foreign states" (The Russian Federation Code, 2007, N 4, Art. 492; N 52, of Art. 6425; 2009, N 42, Art. 4917; 2012, N 3, with the Art. 405) change, having added the paragraph the fourth after words "to carrying out the specified works as" words "; participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair and destruction (utilization) of military products, creation and additional equipment in the territory of foreign states of objects, providing complex field service of the delivered military products, and also import of the military products necessary for production of own military products".

Bring in Item 1 of the Presidential decree of the Russian Federation of December 17, 2007 N 1702 "About some questions of military and technical cooperation of the Russian Federation with the foreign states and of change and recognition which voided separate acts of the President of the Russian Federation" (The Russian Federation Code, 2007, N 52, Art. 6425; 2012, N 3, the Art. 405) change, having added it with subitems "g", "d" and "e" of the following content:

"d) participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair and destruction (utilization) of military products;

e) creations and additional equipments in the territory of foreign states of the objects providing complex field service of the delivered military products;

e) import of the military products necessary for production of own military products.".
