About modification and amendments in the Law on the state position and the status of the government employee No. 158-XVI of July 4, 2008

The Parliament adopts this organic law.

Art. I. - In the Law on the state position and the status of the government employee No. 158-XVI of July 4, 2008 (Official monitor of the Republic of Moldova, 2008, No. 230-232, of the Art. 840), with subsequent changes, to make the following changes and additions:

1. To add article 2 after the concept "responsible state position" with concepts of the following content:

"vacant state position the - not replaced, free state position;

temporarily vacant state position - the state position with which owner the office relations are suspended or the owner of which is recalled to other body of the public power or, on circumstances, provides temporary execution of the leading state position;".

2. In part (3) Article 4:

in Item c) of the word "administrative (protection, economic works, works on content, repair and servicing)" to replace with the word "administrative";

add part with Item-1) from the following content:

"with-1) the personnel employed for certain period at the expense of additional incomes and other sources;".

3. In Article 8:

Item c) parts (to state 2) in the following edition:

"c) state secretary of the ministry, deputy manager of administrative authority;";

part (to add 4) with Item d) the following content:

"d) have experience of management activity at least two years.".

4. Part (Article 9 to add 1) with Items j), k) and l) the following content:

"j) chief of the secretariat of degree of jurisdiction;

k) chief of staff of Central Election Commission;

l) chief keeper of funds.".

5. Add Article 25 with part (2-1) following of content:

"(2-1) Government employee have no right to perform business activity, excepting the status of the founder of economic society, or with use of the position to help business activity of physical persons and legal entities.".
