About entering into some resolutions of plenum of the Supreme Economic Court of Ukraine of the amendments and changes concerning participation of the prosecutor in legal procedure

According to Item "About judicial system and the status of judges" the plenum of the Supreme Economic Court of Ukraine DECIDES: 6 parts two of article 36 of the Law of Ukraine

Due to the changes which happened in the Law of Ukraine "About prosecutor's office" and in the Economic Procedure Code of Ukraine concerning participation of the prosecutor in legal procedure to make such changes and additions to resolutions of plenum of the Supreme Economic Court of Ukraine.

1. The first - third Item 2 of the resolution of plenum of the Supreme Economic Court of Ukraine of 11.10.2010 No. 2 "About some questions of practice of application of the Section XII-2 of the Economic Procedure Code of Ukraine" to replace paragraphs with two paragraphs in such edition:

"Party litigants, the third parties, the Attorney-General of Ukraine, his first deputy and deputies are given the right to the address with the statement for review by the Supreme Court of Ukraine of judgments of economic courts.

From contents of article 121 of the Constitution of Ukraine, articles 2 and 29 HPK and article 36-1 of the Law of Ukraine "About prosecutor's office", and also Solutions of the Constitutional Court of Ukraine of 08.04.99 No. 3-rp/99 in the matter of No. 1-1/99 follows that the prosecutor can file the corresponding petition only for the benefit of the citizen or for the benefit of the state".
