About approval of Industrial safety rules for workers of sewing production

According to article 28 of the Law of Ukraine "About labor protection", the subitem 41 of item 4 of the Regulations on the Ministry of emergency situations of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 402 I ORDER:

1. Approve Industrial safety rules for workers of sewing production who are applied.

2. Declare invalid the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of November 22, 2006 No. 5 "About approval of Industrial safety rules for sewing production", registered in the Ministry of Justice of Ukraine on December 8, 2006 for No. 1292/13166.

3. To public service of mountain supervision and industrial safety of Ukraine (Hokhotva O. I.) in accordance with the established procedure:

3.1. Provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3.2. Enter the order in the State register of regulatory legal acts concerning labor protection.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the Chairman of Public service of mountain supervision and industrial safety of Ukraine Hokhotva O. I.

Industrial safety rules for workers of sewing production

І. General provisions

1.1. These rules extend to all subjects of managing irrespective of patterns of ownership and legal form which use wage labor and perform the activities connected with production of garments.

Requirements of these rules are obligatory for accomplishment by employers and workers of sewing production.

These rules regulate requirements to safe performance of works in engineering procedures of sewing production.

1.2. For prevention of injury rate, occupational diseases and accidents on production the employer shall according to the Law of Ukraine "About labor protection" create in each structural division, on each workplace of working condition according to regulations of the current legislation, and also provide observance of requirements of the legislation concerning the rights of workers in the field of labor protection.

1.3. The employer shall develop and approve the instructions for labor protection existing at the company, according to requirements of the Regulations on development of instructions for labor protection approved by Gosnadzorokhrantrud's order of Ukraine of January 29, 1998 No. 9, registered in the Ministry of Justice of Ukraine on April 7, 1998 for No. 226/2666.

1.4. Training and examination concerning labor protection of workers of sewing production shall No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 231/10511 and No. 232/10512 is carried out according to requirements of the Standard regulations on procedure for carrying out training and examination concerning labor protection and the List of works with the increased danger, Gosnadzorokhrantrud approved by the order of Ukraine of January 26, 2005.

1.5. Preliminary (during employment) and periodic (during labor activity) medical examinations of workers are performed according to the Law of Ukraine "About labor protection" and the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

1.6. Investigation and accounting of accidents, occupational diseases and accidents are made according to the Procedure for carrying out investigations and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232.

1.7. For the purpose of the organization of accomplishment of the legal, organizational and technical, social and economic and treatment-and-prophylactic actions directed to prevention of accidents, occupational diseases, accidents in the course of work and taking into account specifics of production the employer shall create security service of work according to requirements of the Standard regulations on security service of the work approved by Gosnadzorokhrantrud's order of Ukraine of November 15, 2004 No. 255, registered in the Ministry of Justice of Ukraine on December 1, 2004 for No. 1526/10125.

1.8. During execution of an employment agreement according to requirements of the Law of Ukraine "About labor protection" the employer shall inform the worker on receipt on working conditions and on availability on its workplace of dangerous and harmful production factors which are not eliminated yet, possible effects of their influence on health and about the worker's rights to privileges and compensations for work in such conditions according to the legislation and the collective agreement.

1.9. Workers who are allowed to performance of works in production processes of sewing production shall have the corresponding professional training and correspond to the physiological and psychophysiological features necessary for performance of works.

ІІ. General production requirements for labor protection

1. Requirements to the territory, factory buildings and rooms of the subject of managing

1.1. The territory of the subject of managing and buildings located on it shall meet the requirements of the Fire safety regulations in Ukraine approved by the order of the Ministry of Emergency Situations of Ukraine of October 19, 2004 No. 126, registered in the Ministry of Justice of Ukraine on November 4, 2004 for No. 1410/10009 (further - NAPB A.01.001-2004).
