About entering of amendment into the Criminal code of the Kyrgyz Republic

Article 1.

Bring in the Criminal code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1998, No. 7, the Art. 229) the following amendment:

add Chapter 24 with Article 236-1 of the following content:

"Article 236-1. Substandard construction

1. Delivery and (or) acceptance in operation to substandardly constructed, incomplete or not corresponding terms of the contract and the project documentation of buildings and constructions, power plants, apartment houses or other construction objects the contractor, the head of the construction organization and the official exercising control of quality of construction, and equally in their low-quality repair by operators if it entailed on imprudence causing heavy or less severe harm to health of the person,

are punished by penalty in the amount up to hundred settlement indicators or imprisonment for a period of up to three years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years.

2. The same acts which entailed the death of the person or other heavy effects on imprudence are punished by imprisonment for a period of up to five years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years.

3. The acts provided by part one of this Article, which entailed the death of two or more persons on imprudence are punished by imprisonment for a period of three up to seven years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years.".
