About establishment of criteria of unsecured loan (blank credit)

1. Determine that for the purposes of Item 3 of article 35 of the Law on banks unsecured loan (blank credit) the credit which is at the same time corresponding to the following criteria is recognized:

1) the loan amount exceeds percent 0,02 from the size of equity of the bank calculated according to requirements of the resolution of Board of the Agency of the Republic of Kazakhstan for regulation and supervision of the financial market and the financial organizations of September 30, 2005 No. 358 "About approval of the Instruction about normative values and technique of calculations of prudential standard rates for banks of the second level" (registered in the Register of state registration of regulatory legal acts at No. 3924) (further - the resolution No. 358);

2) providing, stipulated by the legislation the Republic of Kazakhstan, except for penalties, in total covers less than 50 (fifty) percent of obligations of the borrower on the issued credit or is absent.

These criteria extend to again issued unsecured loans (blank credits).

2. Unsecured loan (blank credit) the credit corresponding to criteria, the stipulated in Item 1 this resolution, issued by parent bank of the affiliated organization acquiring doubtful and bad assets of parent bank is not recognized.
