The state inspectorate of Ukraine for safety on the land transport handled the issues stated in your letter of 14.01.2013 No. 11.1./7-12.1/329 and within competence reports about the following.
According to the Agreement between the Government of Ukraine and the Government of the Republic of Armenia on the international automobile communication of 22.07.1997 vehicles which carry out transportation are mutually exempted from any charges for driving by roads through the territory of the Contractual Parties. Considering that the specified agreement is ratified by the Verkhovna Rada of Ukraine and consequently treats the national legal system, it is impossible to establish conditions of transportations which will contradict it.
Considering it, determination of need of charge of fare by highways of Ukraine shall be carried out according to the specified Agreement. That is, in case of journey by the territory of Ukraine the Armenian carriers are exempted from payment of fare by highways of Ukraine (for each kilometer of journey) if another is not specified at the permission.
As for collection of part of single collection from carriers of Serbia, release from payment is possible only in the presence of permission of Ukraine (passenger or cargo).
Concerning the last question concerning release from permissions of vehicles of category "Euro 3 Safe" above, it is necessary to notice that according to the Minutes of the ukrainskoturetsky Mixed Commission of April 08-09, 2008 since 01.07.2008 accomplishment without the corresponding permissions of transit transportations on the territory of the Contractual Parties of cargo vehicles (with load or empty) is allowed to category "EURO 3 safe" above in the presence of complete set of ecological certificates. In case of journey by the territory of Ukraine the specified rule is applied only to cargo vehicles of Turkey and does not extend to passenger traffic, other types of transport and carriers of other countries.
