The public registration service in connection with numerous addresses concerning exemption of the state fee during state registration of the corporeal rights and their burdenings (further - state registration of the rights) which arose and are registered according to the legislation which was effective till 01:01. 2013, asks to report to bodies of state registration of the rights and notaries the following information.
According to part four of article 3 of the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings" (further - the Law) the rights to real estate and their burdenings which arose to the introduction in operation of the Law are recognized valid in case of lack of their state registration provided by the Law if registration of the rights and their burdenings was carried out according to the legislation which affected the moment of their origin or if at the time of emergence of the rights and their burdenings the legislation which did not provide obligatory registration of such rights and their burdenings was effective.
So, till January 1, 2013 state registration:
• the property rights and rights to use (servitude) to the real estate units located on the parcels of land; rights to use (hiring, lease) by the building or other capital constructions, their separate parts; the property rights to objects of construction in progress, and also accounting of ownerless real estate, trust management of real estate it was carried out by the registrars of bureau of technical inventory count created to the introduction in operation of this Law and connected to the Proprietorship register on real estate;
