About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus concerning implementation of ministerial procedures in the field of environmental management

According to article 6 of the Law of the Republic of Belarus of December 12, 2012 "About modification and amendments in some laws of the Republic of Belarus concerning implementation of ministerial procedures in the field of environmental management" the Council of Ministers of the Republic of Belarus DECIDES:

1. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in the resolution of Council of Ministers of the Republic of Belarus of January 23, 2007 No. 75 "About implementation of the Law of the Republic of Belarus "About hydrometeorological activities" (The national register of legal acts of the Republic of Belarus, 2007, No. 32, 5/24626; 2008, No. 40, 5/26759; 2009, No. 119, 5/29736; 2010, No. 118, 5/31768; National legal Internet portal of the Republic of Belarus, 18.10. 2012, 5/36348; 06:02. 2013, 5/36850):

1.1.1. to exclude from the paragraph of third Item 1 of the word "and issues of registration certificates of producers of hydrometeorological information in it";

1.1.2. To be reworded as follows the regulations on procedure for maintaining the State register of producers of hydrometeorological information and issue of registration certificates of producers of hydrometeorological information in it approved by this resolution it (is applied);

1.1.3. in appendix 1 to the Regulations on procedure for provision by the public hydrometeorological service of hydrometeorological information to consumers of such information approved by this resolution, line item

1.4. Items 6. 27, 6.30 and 6.32 single lists of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (National register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330), to exclude.

2. This resolution becomes effective since March 16, 2013.

Regulations on procedure for maintaining the State register of producers of hydrometeorological information

1. This Provision determines procedure for maintaining the State register of producers of hydrometeorological information.

2. Action of this provision does not extend to divisions of Armed Forces of the Republic of Belarus, other troops and military forming performing production of hydrometeorological information.

3. The state register of producers of hydrometeorological information (further - the State register) represents the list of information about producers of hydrometeorological information, and also data on the works performed by them and the rendered services constituting production of hydrometeorological information.

4. The data included in the State register are used for:

ensuring the state accounting of producers of hydrometeorological information;

control in the field of hydrometeorological activities.

5. Maintaining the State register is performed by the Ministry of Natural Resources and Environmental Protection (further - Ministry for Protection of the Environment and Natural Resources) in form according to appendix 1.

6. For inclusion in the State register the producer of hydrometeorological information sends within ten working days after the beginning of production of hydrometeorological information or accomplishment of separate works and rendering the services constituting this type of hydrometeorological activities to Ministry for Protection of the Environment and Natural Resources the written application in form according to appendix 2 and the following data:

name of the organization (surname, name, middle name of the individual entrepreneur), address of her (his) location;

number and date of the constituent document of the organization (registration certificates of the individual entrepreneur);

the list of the structural divisions of the organization (including isolated) which are directly performing production of hydrometeorological information or performing separate works and rendering services, it components, the location of these divisions;

the list of Items of hydrometeorological observations (in case of their availability), date of their organization, the address (location), the short characteristic of location of Item of hydrometeorological observations;

summary of the program of the made hydrometeorological observations;

list of technical equipment of Item(s) of hydrometeorological observations;

methods of transfer of the primary data obtained as a result of hydrometeorological observations, the place, methods and storage durations of primary data of hydrometeorological observations, purpose of the made hydrometeorological information;

documentary confirmed data on qualification of the workers in the field of hydrometeorological activities performing works and (or) rendering the services constituting production of hydrometeorological information;

the list of the works and (or) services constituting production of hydrometeorological information;

start dates and (or) cessation of production of works and (or) rendering the services constituting production of hydrometeorological information.

Inclusion of the producer of hydrometeorological information in the State register is performed within five working days after the receipt of the statement and data specified in part one of this Item.

In case of the direction the producer of hydrometeorological information of the statement and the data which are not corresponding to part one of this Item or not in full Ministry for Protection of the Environment and Natural Resources has the right to refuse inclusion in the State register with indication of causes of failure.

7. In case of change and (or) the amendments of the data specified in Item 6 of this provision and included in the State register, producer of hydrometeorological information in a month from the date of when data changed or it is necessary to add them, notifies on this Ministry for Protection of the Environment and Natural Resources.

8. Responsibility for reliability of the data sent to Ministry for Protection of the Environment and Natural Resources is born by the producer of hydrometeorological information.

9. Responsibility for compliance of the information provided by the producer of hydrometeorological information, to the data included in the State register bears Ministry for Protection of the Environment and Natural Resources.

10. Ministry for Protection of the Environment and Natural Resources notifies the producer of hydrometeorological information on inclusion it in the State register within 5 working days from the date of inclusion in the State register.

11. For exception of the State register the producer of hydrometeorological information directs to Ministry for Protection of the Environment and Natural Resources the written application in form according to appendix 3.

12. Ministry for Protection of the Environment and Natural Resources notifies the producer of hydrometeorological information on exception it from the State register within 5 working days from the date of exception of the State register.

Regulations on order of registration of the objects for use of waste put into operation

1. This Provision developed according to part one of Item 3 of article 28 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" (The national register of legal acts of the Republic of Belarus, 2007, No. 183, 2/1368), is determined order of registration of the objects for use of waste put into operation in the register of objects for use of waste.

2. Operation of the objects which are not included in the register of objects for use of waste is not allowed.

3. For registration of the objects for use of waste put into operation the legal entities or individual entrepreneurs having the property right to objects and legal entities or individual entrepreneurs performing their operation, or authorized by them represent to the organization authorized by the Ministry of Natural Resources and Environmental Protection on maintaining the register of objects for use of waste (further - body of maintaining the register), the documents provided in Item 6.29 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330).

4. Registration of object for use of waste in the register of objects for use of waste or decision making about refusal in its registration is made within one month from the date of submission of documents.

5. Registration of object for use of waste in the register of objects for use of waste is confirmed by the registration certificate granted by body of maintaining the register in the form established by the Ministry of Natural Resources and Environmental Protection.

6. The object for use of waste put into operation is considered registered from the date specified in the certificate on its registration.

7. Registration of the objects for use of waste of 1-3 classes of danger put into operation if according to the legislation implementation of the specified type of activity requires receipt of the corresponding special permission (license) for implementation of the activities connected with impact on the environment is made after receipt of special permission (license).

8. Objects on which use of waste is performed within carrying out research, developmental works are not subject to registration in the register of objects for use of waste.

9. Legal entities and individual entrepreneurs within one month address to body of maintaining the register for receipt of the new registration certificate of object for use of waste in cases:

changes of the name of the legal entity, surname, own name, middle name of the individual entrepreneur, reorganization of the legal entity;

constructions, reconstruction, expansions, technical retrofitting, upgrade, change of profile of production of the legal entity and the individual entrepreneur who entailed change of the list of the waste which is subject to use.

10. The object exception of the register of objects for use of waste is performed in cases:

unauthenticity of the data specified in the statement;

terminations of activities for use of waste by object for use of waste;

liquidations, reorganization (except as specified when other legal entity joins the legal entity) the legal entity, the termination of activities of the individual entrepreneur.

11. The decision on exception of object for use of waste of the register of objects for use of waste, cancellation of the registration certificate of object for use of waste can be appealed by the owner of this object according to the procedure, established by the legislation.

12. The body of maintaining the register within 10 days from the date of receipt of information specified in Item 10 of this provision performs object exception of the register of objects for use of waste and in writing notifies the owner of object for use of waste on its exception of the register of objects for use of waste, and also on cancellation of the registration certificate of this object with indication of the bases of its cancellation and date with which the certificate is considered cancelled.

Regulations on accounting treatment for the objects of storage, burial and neutralization of waste put into operation

1. This Provision developed according to part one of Item 1 of article 31 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" (The national register of legal acts of the Republic of Belarus, 2007, No. 183, 2/1368), is determined accounting treatment for the objects of storage, burial and neutralization of waste put into operation in the register of objects of storage, burial and neutralization of waste.

2. Accounting of the objects of storage, burial and neutralization of waste put into operation (further - objects) is performed by the organization authorized by the Ministry of Natural Resources and Environmental Protection on maintaining the register of objects of storage, burial and neutralization of waste (further - body of maintaining the register), based on represented by the legal entity or the individual entrepreneur having the property right to objects and the legal entity or the individual entrepreneur of the statement performing their operation, or authorized by it in the form established by the Ministry of Natural Resources and Environmental Protection, way of inclusion of data on objects to the register of objects of storage, burial and neutralization of waste.

3. Accounting of objects is performed after receipt of special permission (license) for implementation of the activities connected with impact on the environment if according to the legislation its obtaining is required.

4. Objects on which neutralization of waste is performed within carrying out research, developmental works are not subject to accounting in the register of objects of storage, burial and neutralization of waste.

5. The exception of objects of the register of objects of storage, burial and neutralization of waste is performed in cases:

unauthenticity of the data specified in the statement;

terminations of activities for storage, burial, neutralization of waste;

liquidations, reorganization (except as specified when other legal entity joins the legal entity) the legal entity, the termination of activities of the individual entrepreneur.

6. The decision on object exception of the register of objects of storage, burial and neutralization of waste can be appealed by the owner of this object according to the procedure, established by the legislation.

7. The body of maintaining the register within 10 days from the date of receipt of information specified in Item 5 of this provision performs object exception of the register of objects of storage, burial and neutralization of waste and in writing notifies the owner of object on its exception of the register of objects of storage, burial and neutralization of waste.
