About the deposit guarantee of physical persons
This Law establishes legal and organizational basis of procedure for the guaranteed compensation of household deposits in banks in cases of their liquidation or bankruptcy.
This Law governs the relations arising in connection with guaranteeing household deposits by fund in the procedure established by this Law.
The guarantee of compensation of household deposits in Savings bank of the Republic of Tajikistan is performed according to the procedure, provided by the Law of the Republic of Tajikistan "About banks and banking activity".
Household deposit - the money in national or foreign currency deposited to account physical person (investor) which the bank shall compensate after certain time with percent.
Fund of the deposit guarantee of physical persons (further Fund) the legal entity founded for the purpose of accumulation of means for the guaranteed compensation of household deposits.
The amount of the guaranteed compensation of deposits - sum of money which is paid by Fund to physical person (investor) after decision making about liquidation or bankruptcy of bank as difference between the deposit amount and the amount allocated with liquidation commission of bank at the rates determined in article 5 of this Law.
The legislation of the Republic of Tajikistan on the deposit guarantee of physical persons is based on the Constitution of the Republic of Tajikistan, consists of this Law, other normative legal acts of the Republic of Tajikistan and the international legal acts recognized by the Republic of Tajikistan.
