Concerning control of the import license of medicines by customs authorities the Law of Ukraine of 04.07.2012 No. 5038-VI "About introduction of amendments to some laws of Ukraine concerning import licensing of medicines and determination of the term "active pharmaceutical ingredient" makes changes to article 17 of the Law of Ukraine "About medicines" according to which on the territory of Ukraine medicines can be imported, in the presence of, in particular, import license of medicines (the specified regulation becomes effective since March 1, 2013).
Please note that according to provisions of Article 197 of the Customs code of Ukraine customs authorities control documents which confirm observance of restrictions concerning movement of separate types of goods through customs border of Ukraine and are issued by the state bodies or other legal entities authorized on their issue if submission of such documents to customs authorities is provided by the laws of Ukraine.
Considering that in the Law of Ukraine of 04.07.2012 No. 5038-VI regulations of rather customs clearance of medicines based on the corresponding import license are not established, the legislative bases concerning control of availability of such license by customs authorities in case of customs clearance of medicines are absent.
