Article 1. Subject of regulation of this Federal Law

This Federal Law according to the Framework convention of the World Health Organization on fight against tobacco governs the relations arising in the field of protection of public health from impact of environmental tobacco smoke, effects of consumption of tobacco or consumption of nikotinsoderzhashchy products.

Article 2. The basic concepts used in this Federal Law

1. For the purposes of this Federal Law the following basic concepts are used:

1) hookah - the device which is used for the generation of aerosol, vapor or smoke arising from decay and (or) heating of tobacco or the products which are not containing tobacco leaf and in which aerosol, vapor or smoke pass through the vessel filled with liquid;

2) tobacco smoking - use of tobacco products for the purpose of inhalation of the smoke arising from their decay;

2. 1) насвай - the type of not smoking tobacco product intended for suction and made of tobacco, lime and other ingredients;

3) nikotinsoderzhashchy products - products which contain nicotine (including received by synthesis) or its derivatives, including nicotine salts, are intended for consumption of nicotine and its delivery by means of suction, chewing, shuffing or inhalation, including product with the heated tobacco, solutions, liquids or gels with content of liquid nicotine in amount mg/ml 0,1, nikotinsoderzhashchy liquid, nicotine free liquid, bestabachny mix for heating, powders, mixes for suction, chewing, shuffing is at least, and are not intended for consumption (except for the medical products and medicines registered in accordance with the legislation of the Russian Federation, the food products containing nicotine in the natural form and tobacco products);

4) nikotinsoderzhashchy liquid - any liquid with nicotine content in amount is at least mg/ml 0,1, held for use in devices for consumption of nikotinsoderzhashchy products, including in electronic systems of delivery of nicotine;

4. 1) nicotine free liquid - any liquid without nicotine content or with its minimum content of less 0,1 of mg/ml, held for use in devices for consumption of nikotinsoderzhashchy products, including in electronic systems of delivery of nicotine;

4. 2) bestabachny mix for heating - the type of nikotinsoderzhashchy or nicotine free product presenting itself the bestabachny mix which is not created in the form of separate portions ready to filling in the devices for consumption of products manually intended for the education of aerosol got by direct or indirect heating of products (without burning) which is inhaled by the consumer when using products with devices for consumption of nikotinsoderzhashchy products, hookahs;

5) food nikotinsoderzhashchy products - nikotinsoderzhashchy products which are intended for consumption and according to the name or with use of visual, organoleptic or analytical method can be identified as food products (except for the food products containing nicotine in the natural form);

6) environmental tobacco smoke - the tobacco smoke containing in atmospheric air of the place in which tobacco smoking, including the tobacco smoke exhaled by person performing tobacco smoking is performed or performed earlier;

7) effects of consumption of tobacco or consumption of nikotinsoderzhashchy products - damnification of life or to health of the person, harm to the circle of its dwelling owing to consumption of tobacco or consumption of nikotinsoderzhashchy products, impact of environmental tobacco smoke as a result of the tobacco smoking or substances emitted in case of consumption of nikotinsoderzhashchy products and also the medical, demographic, social and economic effects connected with it;

8) tobacco consumption - tobacco smoking, suction, chewing, shuffing of tobacco products;

9) consumption of nikotinsoderzhashchy products - suction, chewing, shuffing of the nikotinsoderzhashchy products or inhalation of nikotinsoderzhashchy aerosol, vapor received by their heating by means of devices for consumption of nikotinsoderzhashchy products;

10) sponsorship of tobacco or nikotinsoderzhashchy products - any kind of contribution to any the event, action or the individual, the purpose, result or probable result of which is sales promotion of tobacco products or nikotinsoderzhashchy products or consumption of tobacco or consumption of nikotinsoderzhashchy products directly or indirectly;

10. 1) tobacco sucking (снюс) - the type of not smoking tobacco product intended for suction and fully or partially made of the purified tobacco dust and (or) small fraction of cut tobacco with addition or without addition of other ingredients;

11) the tobacco organizations - the legal entities irrespective of form of business performing production, movement of tobacco products or nikotinsoderzhashchy products through customs border of the Eurasian Economic Union (further - the Union) or through Frontier of the Russian Federation with state members of the Union, or the organizations recognized in accordance with the legislation of the Russian Federation by affiliates of these legal entities, the affiliated and dependent organizations, associations of such persons, and also the organizations created by such persons. For the purpose of this Federal Law the individual entrepreneurs performing production, movement of tobacco products or nikotinsoderzhashchy products through customs border of the Union or through Frontier of the Russian Federation with state members of the Union are equated to the tobacco organizations;

12) devices for consumption of nikotinsoderzhashchy products - electronic or other devices which are used for receipt of nikotinsoderzhashchy or nicotine free aerosol, vapor inhaled by the consumer including electronic systems of delivery of nicotine and the device for tobacco heating, and also their components and elements (except for the medical products and medicines registered in accordance with the legislation of the Russian Federation).
