About reuse of information of the public sector
For the purpose of elimination of barriers on the way of reuse of information of the public sector, creation of the new information products and services based on open data and also for providing fair, proportional and non-discriminatory conditions of reuse of documents of public bodies and organizations
The parliament adopts this ordinary law.
(1) This law creates the necessary legal base for application of the Directive 2003/98/EC of the European Parliament and Council of November 17, 2003 about reuse of information of the public sector published in the Statement of the European Union No. L345/90 of December 31, 2003.
(2) This law governs the relations arising in the course of reuse in commercial or non-commercial purposes of documents which are owned by public bodies and organizations and/or which are in ownership of other legal entities on behalf of the specified bodies and organizations.
(3) the Purpose of this law is simplification of reuse of documents which are in ownership of the public bodies and organizations which created them in the course of the public activities and which can be used afterwards in commercial or non-commercial purposes.
(1) the Relations arising in case of reuse of information which is in ownership of public bodies and organizations are regulated by this law, other regulations, international treaties which party is the Republic of Moldova.
(2) If international treaties which party is the Republic of Moldova establish others, than provided in this law, regulations, regulations of international treaties are applied.
(1) Documents which development was performed at the expense of the public budget or the external help shall be available to reuse, including after their digitization, with the withdrawals provided by parts (2) and (3).
