About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on the status of the local elected person No. 768-XIV of February 2, 2000 (Official monitor of the Republic of Moldova, 2000, No. 34, of the Art. 231), with subsequent changes, to make the following changes and additions:

1. In Article 5:

part (to state 3) in the following edition:

"(3) In the cases provided by Items and), b) and d) parts (2) this Article, the decision on deprivation of the adviser of the mandate is made by the relevant council, and in the cases provided by Items c), f) and g) parts (2) this Article - Central Election Commission.";

add Article with part (3-1) following of content:

"(3-1) Central Election Commission initiate the procedure of deprivation of the adviser of the mandate in case of incompatibility of position only according to the address to her of interested persons with submission of the relevant supporting documents. The Central Election Commission based on the selective documents which are available for it makes the decision on deprivation of the adviser of the mandate within 30 calendar days from the date of bringing to its data of situation on incompatibility of position.".

2. In Article 8:

"(2-1) based on the statement of interested persons the Central Election Commission makes the decision on deprivation of the adviser of the mandate in case of non-compliance with regulations by it on the termination of provision of incompatibility in time, established in part (1) this Article.".

Art. II. - In article 24 of the Law on local public authority No. 436-XVI of December 28, 2006 (Official monitor of the Republic of Moldova, 2007, No. 32-35, of the Art. 116), with subsequent changes, to make the following changes:
