About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on the Constitutional court No. 317-XIII of December 13, 1994 (Official monitor of the Republic of Moldova, 1995, No. 8, of the Art. 86), with subsequent changes, to make the following change and addition:

1. Add the law with Article 25-1 of the following content:

"Article 25-1. Operation of the disputed act

(1) Action of regulations, stipulated in Item and) parts (1) Articles 4, disputed in accordance with the established procedure in the Constitutional court, mentioning or belonging to the areas provided by part (2) this Article, it can be suspended to permission of case on being with removal of final determination or the resolution.

(2) It can be suspended:

1) the acts mentioning or relating to the following areas:

a) sovereignty and government;

b) rights and fundamental freedoms of the person;

c) democracy and political pluralism;

d) separation and interaction of the authorities;

e) basic principles of property;

f) unity of the people and right to originality;

g) economic or financial safety of the state;

h) other areas on which the Constitutional court recognizes necessary to suspend the disputed act in order to avoid inevitable damage and negative effects;

2) published by Parliament, the President of the Republic of Moldova or the Government of acts of individual nature which concern the state officials representing the special public and/or political concerns.

(3) the Constitutional court reviews request about suspension of action of the disputed regulation no later than the second working day after registration of the address.

(4) Determination about suspension of action of the disputed regulation is accepted by plenum of the Constitutional court voices at least three judges. In case of impossibility to convene plenum of the Constitutional court determination about suspension is published by the order of the Chairman of the Constitutional court with obligatory subsequent its approval by plenum of the Constitutional court.
