In case of return by the prosecutor of criminal case to the investigator in connection with identification by court of the circumstances specified in parts one and pervoy.2 articles 237 of this Code, the term of production of investigative and other legal proceedings cannot exceed one month from the date of receipt of criminal case to the investigator. Further prolongation of term of pretrial investigation is made in accordance with general practice according to the procedure, established by parts four, the fifth and seventh this Article.";

"1.2. The judge according to the petition of the party returns criminal case to the prosecutor for removal of obstacles to its consideration by court in cases if:
